HomeMy WebLinkAbout1991 015 CC RESO1991 015 CC RESO(Ì콩 RESOLUTION NO. 91-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A MODIFICATION OF A DEVELOPMENT PLAN TO ELIMINATE THE AUTOMATIC FRONT ENTRANCE SECURITY GATE AND AMENDING RESOLUTION NO. 90-76 APPLICANT: CHIAO MEl DEVELOPMENT; CASE NO. DR-5; LOCATION: 3920-3926 STEWART AVENUE). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY FIND AND RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That the owners of certain real property approximately 83 acres in area located at 3920-3926 Stewart Avenue, more particularly described in the application which is on file in the office of the Secretary of the Planning Commission of the City hereinafter Property") heretofor made said application for a modification of a Development Plan hereinafter Plan") to eliminate the front entrance security gate for said Property; and b) That the Planning Commission conducted a duly noticed public hearing upon said matter and recommended that the same be denied; and c) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented and each member being familiar with the Property, determined that the said application should be granted, subject to the terms and conditions hereinafter set forth. Section 2. That the City Council does hereby adopt the following Findings of Fact: a) The proposed modification does not alter the proposed density of development, which is consistent with the land use policies of the General Plan; and b) The proposed modification does not alter the building architecture and site design, except that removal of the front entry gate and the associated redesign of the front entry wall will provide for an enhanced site appearance and will better integrate the project with the surrounding neighborhood; and therefore, the development as modified maintains a superior quality of architecture and site design, and will not be detrimental to surrounding properties; and Cc) The proposed modification does not change the density of development, nor the site plan and architectural design of the buildings, therefore, the development as modified maintains a logical an rational transition of residential densities between the adjacent RG zoned properties; and BIB] 37650-U01 1991-U02 015-U02 CC-U02 RESO-U02 LI3-U03 FO1126-U03 FO2009-U03 DO2107-U03 C6-U03 RESO-U03 10/10/2001-U04 ADMIN-U04 RESO-U05 91-15-U05 APR-U05 3-U05 1991-U05 1991 015 CC RESO(Ì콩Resolution No. 91-15 Page 2 of 3 a) That the proposed modification does not change the general site layout, consisting of clustered homes and common open space; and that on-site safety will not be compromised by replacing the security gate with a security alarm system to be provided for each unit; and therefore, the development as modified meets the purpose and intent of the Planned Development Overlay Ordinance. SECTION 3. That the above described Plan be, and the same hereby is approved, subject to the following conditions. a) That the site plan Exhibit A") dated February 27, 1991 shall supersede the previously approved site plan Exhibit B") dated August 22, 1990; and *b) That the City Council Resolution NO. 90-71 shall be adhered to except that Section 3, condition m" of said resolution shall be amended to read as follows: m) That a security alarm system shall be provided for each unit to protect all openings windows and doors) and be preequipped to link with the City's Police Department". SECTION 4. That the City" Council relied upon the Administrative Record, and the evidence presented at the public hearing in making the above Findings of Fact, and in reaching the conclusion that the Plan should be conditionally approved. SECTION 5. That the City Clerk shall certify to the adoption of this resolution and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant.
