HomeMy WebLinkAbout1992 022 CC RESO1992 022 CC RESO(Ìì³( RESOLUTION NO.92-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DENYING AN AMENDMENT TO THE BALDWIN PARK ZONING CODE CHAPTER 17.22 TO INCLUDE MINI-MALLS AS USES PERMITTED IN THE C-2, GENERAL COMMERCIAL, ZONE WITH A CONDITIONAL USE PERMIT APPLICANT: MICHAEL MONTGOMERY; CASE NO.: AZC-128). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to the applicable provisions of the Planning and Zoning Law Section 65800 et. seq. of the Government Code of the State of California), studies were commenced for the purpose of amending Chapter 17.22 of the Zoning Code of the City of Baldwin Park to include mini-malls as uses permitted in the C-2, General Commercial, Zone with a conditional use permit; and b) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend denial of the Zoning Code amendment; and c) That the City Council conducted a duly noticed public hearing upon said Zoning Code amendment and based upon the evidence presented, determined that the amendment should be denied based upon the following findings: 1) That the proposed change is not necessary in order to provide for the protection of the health, safety, and welfare of the residents of Baldwin Park; and 2) That the proposed change may result in degrading the aesthetic appearance and tarnishing the City's image; and 3) That the proposed change is not consistent with the spirit and intent of the General Plan. SECTION 2. That based upon the foregoing the City Council hereby denies the here before described Zoning Code amendment. SECTION 3. That the City Council relied upon the evidence presented at the public hearing in making the above findings and denying said Zoning Code Amendment. SECTION 4. That the City Clerk shall certify to the adoption of this Resolution and forward a copy, hereof to the applicant and the Secretary of the Planning Commission. PASSED AND APPROVED on March 18 1992.
