HomeMy WebLinkAbout1992 049 CC RESO1992 049 CC RESO(Ì캬 RESOLUTION NO.92-49 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DENYING AN AMENDMENT TO THE GENERAL PLAN AND ZONE CHANGE APPLICANT: KENOFFEL, ROODMAN AND DALEWOOD PARTNERSHIP; LOCATION: 12800 BLOCK OF DALEWOOD STREET; CASE NO.: AGP-90 & Z-497) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That on the 3rd day of June, 1992, the City Council held a duly noticed public hearing on the application for an amendment to the General Plan Land Use designation from Office Industrial to Multiple Family Residential and a zone change from 01, Office Industrial to R-3, High Density Residential Application) on property located within the 12800 block of Dalewood Street Property) as more fully described in said Application on file in the City Planning Division; and b) That the Planning Commission had previously conducted a public hearing on said Application and recommended to the City Council that it be denied; and c) That the City Council determined that the proposed changes were not necessary in order to provide for the protection of the health, safety, and welfare of the residents of Baldwin Park; and c) That the proposed changes would permit future multiple-family residential development that may exacerbate the existing blighted conditions and crime present within this block of Dalewood Street; and d) That, because of its proximity to and good visibility from the freeway, the most appropriate land use for the Property is Office Industrial; and e) That, if this Application is denied, the Applicant would still possess economically viable use of the Property; and f) That the proposed change is not consistent with the spirit and intent of the General Plan. SECTION 2. That the City Council relied upon the evidence presented at the public hearing, among other things, in reaching the conclusion that the Application should be denied. SECTION 3. That the City Council hereby denies said Application case nos. AGP-90 & Z-497 as herein described. SECTION 4. That the City Clerk shall certify to the adoption of this Resolution and shall forward a copy hereof to the Secretary to the Planning Commission and the Applicant. PASSED AND APPROVED on June 3 1992.
