The City Attorney refuted the arguments advanced by Mr. Hat if and sustained his previous ruling that the Dunkin seat became vacant February t, 1957; that a majority of the Council had not been recalled on February 26, and that the Council was authorized to fill the Dunkin vacancy within thirty 30) days by appointment, or failing that, were required to call a special election for that purpose; that the Blexham and Scovott i seats would be vacant upon canvass of the ballot and that the Council must set an election date to fin the vacancies.
