Durkin was a member of the City Council Inasmuch as notion of his conviction had not been furnished the Council as required by Sec. 1771 of the kwerni ent Code, consequently that he had been recalled at the election on hbrumy 26, 9576 that as a result, a rajority of the Couoeil had been recalled and that action required by Sec. 11121 of the Oarsrrnoent Code should be taken, to tit: All members of the Council recalled should hold their office and continue to function until their successors were chosen and q alified. The City Attorney refuted the arguments advanced by Mr. Hat if and sustained his previous ruling that the Dunkin seat became vacant February t, 1957; that a majority of the Council had not been recalled on February 26, and that the Council was authorized to fill the Dunkin vacancy within thirty 30) days by appointment, or failing that, were required to call a special election for that purpose; that the Blexham and Scovott i seats would be vacant upon canvass of the ballot and that the Council must set an election date to fin the vacancies.
