Adjourned Regular Meeting The City Council of the City of Baldwin Park met in adjourned regular session at the above place at 700 P.M. Roll Call: Present: Councilman Bishop, Stephens, Mayor Cole, Chief Administrative Officer Asmus, City Attorney Gorlick, City Engineer Young and City Clerk Balkus Absent: Councilman Holmes and Littlejohn Couno11 w Stephens moved that the absence of Councilman Littlejohn and Councilman Holmes be noted and excused. Councilman Bishop seconded and it was agreed unanimously and so ordered by Mayor Cole. 00- Chief Administrative Officer Asnus reported that a letter had been received from Ferguson and Judge Attorneys who are handling the court cases for the City of Baldwin Park, and that City Attorney Gorlick had prepared a Resolution wetaining them to defend the City. City Clerk Balkus read, tote letter from Ferguson and Judge. The law firm stated they propose to represent the City of Baldwin Park in the two lawsuits now pending Josenhans and the Hopkins-Caillier cases) until judgements have become final which will, if necessary, include appeals and the appellate courts. Their fees for such representation will be $25.00 per hour for research, office preparation and time in court, plus all court costs. Chief Administrative Officer Asmus read the Resolution prepared by City Attorney Gorlick. There was some discussion among the Councilmen regarding a misunderstanding of the fees requested; however, it was the opinion of all that, whether or not there was a misrepresentation, it would be more feasible in every way for Ferguson and judge to con- tinue with the cases rather than have another attorney, who would be unfamiliar with the cases, gather the material to the point as it now stands. Councilman Stephens moved that the Resolution be adopted. Councilman Bishop seconded, and the motion carried as follows: AYES: Councilman Stephens, Bishop, Mayor Cole NOES: None ABSMNTs Councilman Holmes and Littlejohn 00- City Engineer Young stated there was unnecessary expense on Pacific Avenue Sewers and with deletion of two parcels, the cost could be cut. It was suggested that the necessary Resolution of Intention be drawn up deleting the two parcels and the action on Pacific Avenue 1957-4 could then proceed. Moved by Councilman Stephens and seconded by Councilman Bishop that the hearing on 1911 Act, Pacific Avenue 1957-4 be held over until August 18, 1958 for Council action. Councilman Stephens seconded and the motion carried as follow: AYES: Councilman Stephens, Bishop, Mayor Cole NOES: None ABSENT: Councilman Holmes and Littlejohn 00- Chief Administrative Officer Asmus informed the Council that City Engineer Young is prepared to do a lot of his own work, but to do so, will need equipment and an Assistant. Councilman Stephens concurred with Mr. Asmus in that if the Engineer- ing Office was to function properly, the equipment necessary to do so should be available. Mr, Assns said the allocation of a sum not to exceed $1,250.00 would be sufficient, and within the budget. Councilman Bishop moved that the Chief Administrative Officer be authorized to purchase the equipment. Councilman Stephens seconded and the motion carried as follows: AYES: Councilman Stephens, Bishop, Mayor Cole NOES: None ABSENT: Councilman Holmes and Littlejohn 00- Mayor Cole reported that he had talked with Mr. Zachary regarding the Puente Avenue Bridge, stating that possibly the City can get help with the removal of the bridge, the ditch filled and paved= and suggested that the Chief Administrative Officer and City Engineer investigate. Councilman Stephens expressed his desire to get the subject on the Agenda as soon as possible, and Chief Administrative Officer Asmus said he hoped to have something definite to report by the next Council Meet- ing* 00- Councilman Stephens told the Council that recently he was a witness to a shotgun fracas on Puente Street and that, in his opinion, the three Baldwin Park Police Officers called to the scene, were very cool-headed August 11, 1958 Page 2 Holt" Ave. to Pacific" Ordinance re change in location of Council Chamber & City Hall given second reading and adopted. Mayor Cole suggested that Chief Administrative Officer Aamus have a Resolution prepared expressing the City*s admiration and appreciation and that it be presented to the three officers. 00- Councilman Stephens moved that the meeting adjourn.
