The City Council of the City of Baldwin Park met in regular session in the Council Chambers of the City Hall at 7:30 P.M. on Monday, September 15, 1958. Councilman Holmes led the salute to the flag. FLAG SALUTE The invocation was given by the Reverend H. 0. Black of the First INVOCATION Southern Baptist Church in Baldwin Park. 00- Roll Call: Present: Councilman Bishop, Holmes, Stephens, Littlejohn, Mayor Cole, Chief adminis- trative Officer Asmus, Acting City Attorney Gorlick, and City Clerk Balkus. Absent: City Treasurer Pugh 00- Councilman Littlejohn moved that the Minutes of the September 2, 1958, Council Meeting be approved with reading waived. Councilman Stephens seconded the motion. Councilman Holmes called attention to an error on Page 6, in the Stavness Set-Back Violation paragraph. The street number being 4018 North Walnut" instead of 5018 West Walnut". The minutes to be corrected as instructed and the notion was so amended by Councilman Littlejohn and seconded by Councilman Stephens. There were no objections and the motion was so ordered by Mayor Cole. 00- City Clerk Balkus read a letter from Mr. W. D. Zachery of Trade- land Realty. Mr. Zachery stated he would wreck and remove, at his expense, the bridge on Puente Avenue at East Ramona Boulevard, providing he could have all the material in the bridge except the metal guard rails which would be removed at City expense. Mr. Zachery proposed to remove the bridge down to the cement abutments and requested thirty days from time of approval to complete the job. Chief Administrative Officer Asmus told the Council the letter was in response to a telephone conversation he had had with Mr. Zachery, and that the letter was the written verification of Mr. Zachery's proposal the Council had requested at a prior meeting. Considerable discussion followed concerning the acceptance of Mr. Zachery's proposal, or whether the City should accept bids, Council- man Littlejohn stated he felt there were only two parties who would benefit by this, and that the expenditure for the benefit of only two property owners would not be justifiable. He said, in his estimation, he thought a complete set of specifications whould be drawn up by the City Engineer concerning the City's part, and offer them for bid so that the exact amount of money that would be spent by the City would be known before any action was taken in granting Mr. Zachery the privilege of removing the bridge. He also mentioned the fact that a portion of the guard rails would have to be replaced to protect Johnny's No-Bone Steak House. Councilman Bishop concurred with Councilman Littlejohn in that he felt the property owner who would benefit, as well as Mr. Zachery, should share equally in the expense of the removal of the bridge, and also, that he did not feel he could vote for something whereby only twou property owners would be getting 95% of the benefit. September 15, 1958 Page 2 Chief Administrative Officer Asmus said that the last time he had- talked with Mr. Zachery he had indicated that the other property owner would be going in with his. This would reduce Mr. Zachery's expenses which were estimated at $400.00. Councilman Stephens stated that, in his opinion, when the bridge was removed, the property owners would-benefit anyway; that the bridge was going to have to be removed sooner or later; that the City now has the opportunity to get. the bridge removed at no cost whatsoever to the City; and, furthermore, if it could be done while the street was closed, he thought it would be much better than to have the street tied up again later for another 60 or 90 days. Councilman Holmes said since the City is faced with the problem of re- moving the bridge sooner or later, he considered Mr. Zachery's proposal a good step in the right direction; it is a through street, the City's obligation, and would benefit the general public. On that basis, he moved that the Council accept Mr. Zachery's offer to remove the bridge for the salvage, at no cost to the City, and that the City reserve the metal guard rails which will be removed at the City's expense. He in- cluded in the notion that Mr. Zachery was not to remove the bridge Until the City authorized him to do so. Councilman Stephens seconded and the motion carried three to two as follows: AYES: COUNCILMAN HOLMES, S18PHENS AND MAIOR COLE NOES: COUNCILMEN BISHOP AND LITTLBJOBN ABSENT: NONE Councilman Stephens moved that the Chief Administrative Officer authorize the City Engineer to bring this matter before the Council with plans and specifications for the completion of this street, ex- cept for the removal of the bridge, at the next Council Meeting, if- possible. This ram between the City Council and the firm of O'Melveny and Myers. The agree- ment was given to Acting City Attorney Gorlick for his perusal before reading. It was moved by Councilman Stephens and seconded,by Councilman Bishop that the following Resolution be read by title only. Young to the City Council with plans, specifications, profile, area map and estimates of cost, as approved by O'Melveny and Myers covering the 1911 Act Improvement District No. 1957-8, Central Avenue. There were no objections and the motion was so ordered by Mayor'Cole. 00- In Reports of Special Committees,:Councilman Littlejohn said that a melting was scheduled at 9:30 A.M. on September 17, 1958, with Mr. Bonelli, in his office in Los Angeles, in regard to the Badillo Storm Drain. Mr. Pittinger of West Covina was also planning to attend. The Committee planned to ask for further planning on the part of Mr. Kennedy and his recommendation. Councilman Littlejohn said any one who wished to attend the meeting was welcome. 00- Councilman Littlejohn reported on the Civilian Defense Meeting. Colonel Ming, a retired Colonel, was appointed Area D" Co- ordinator on a temporary basis to see whether he would carry on the work of Colonel Welling. Colonel Ming. takes office September 16, 1958. 00- Councilman Stephens said there will be no report on the joint Recreation Committee of the School District until the first Council Meeting in October. The regular meeting of the Joint Recreation Committee of the School District will be held on the last Monday of every month. 00- A written and oral report on the Lot Split Ordinance and recommendations as to how it can be improved, was given to the Council by Acting City Attorney Gorlick. The provision that causes the most difficulty is Section 9307 which re- quires the City Council to make findings, which is the only thing that Council is required to do. These findings should be made by the Planning Commission before the matter goes to the City Council. Before the Planning Commission makes its findings and acts on the lot split, the Planning Director and City Engineer should make a thorough investigation of the proposal and report to the Commission. Councilman Stephens moved that the City Attorney's report re- garding the Lot Split Policy be referred to the Chief Adminis- trative Officer and the Planning Commission, and that their recommendations be brought before the Council. Councilman Holmes seconded. There were no objections and the motion was so ordered by Mayor Cole. 00- Acting City Attorney Gorlick read aloud his report pertaining to the Zoning Case No. 18, Frank Campuzano, C-1 to C-4 Zone Variance, at 3723 North Baldwin Park Boulevard, copies of which had been given to each Councilman prior to the meeting. Councilman Holmes remarked that he would like to recommend that the report of the City Attorney be taken under advisement and further study made before any action was taken; and that he would like to have a clearer comprehensive view of the entire case before he would feel qualified to take any action. Councilman Stephens explained the reason this came up for legal opinion was, that there were, when the variance was granted, certain conditions to be met by the applicant because, to the best of the Council's ability, none of the conditions were met; and, therefore, the Council wanted the complete status of the zone change. Councilman Holmes said he thought it would be well for the Council to get up-to-date on all the ramifications involved-- whether they have been complied with or whether they haven't, and he made the motion that it be taken under study by the Council and Planning Commission and be brought back to the first Council meeting in October. Councilman Stephens seconded. There were no objections and the motion was so ordered by Mayor Cole. With reference to the question whether Mr. Campuzano had complied with the conditions required with the original variance, Chief Administrative Officer Asmus informed the Council that Mr. Campuzano has, and is now, in the process of installing curbs, etc., and is working under the variance. 00- Acting $ity Attorney Gorlick read aloud his report pertaining to the Stella R. Senn, Zoning Case No. 23, A-1 to M-i Zone Change, Tubing Seal Cap Variance, copies of Which had been given to each Councilman prior to the meeting. On the basis of his analysis, Attorney Gorlick's recommendations were that it be ascertained whether the variance had been utilized, and if so, when such use was begun; if the variance had expired, no extention should be granted and the ordinance should be repealed and the owner required to institute a completely new proceeding. If the variance had not expired, a conference with the owner should be arranged to discuss the legal questions. In any new proceeding the granting of a variance for all M-1 uses should be avoided a variance should be limited to the particular use requested. Action should be taken to repeal Section I of the Senn zone variance ordinance as this was the section that purports to amend the zone map. Councilman Holmes seconded. There were no objections and the motion was so ordered by Mayor Cole. Acting City Attorney Gorlick informed. the Council that he was now ready to file the summons of complaint in the McCauley action, and that he would give copies of the complaint to Chief Administrative Officer Asmus. 00- With reference to the 1911 Act petitions, Chief Administrative Officer Asmus informed the Council that the City had been follow- ing a policy O'Melveny and Myers had outlined, but in checking with other cities he learned that they do not always use two petitions. O'Melveny and Myers were a bit reluctant, but did finally agree to having a 1911 Act petition drawn which will not show the legal description of the property involved in the pro- ceedings. Mr. Asmus said he could foresee certain administra- tive problems developing by using this, and that it is, many times, a little difficult to determine the exact area involved and the number of petitions to be circulated; however, legal descriptions will not be needed in getting things started. He concluded that if the Council desired, one petition on the 1911 Act will be prepared and made available to be used in that proceeding. Councilman Holmes moved that we proceed with the preparation of the proper 1911 Act petitions for the use of citizens of Baldwin Park circulating petitions to process the 1911 Act) with one petition rather than have to make two as in the past. Councilman Bishop seconded the motion. There were no objections and the motion was so ordered by Mayor Cole. 00- Mr. Lackey informed the Council that he had a sufficient number of signatures for Jeramie Street, if there was only going to be one petition. Chief Administrative Officer Asmus said that he thought in the case of Chevalier, as well as Jeremie Street, the petition Mr. Lackey had would not be sufficient, as it was not on the approved form; that we probably won't have to have the legal on the property involved, but there will have to be a re- signing. Mr. Lackey has the names and, in most cases, the addresses on the petitions, and City Attorney Gorlick then advised the Council that this would suffice as a legal petition so it will not be necessary for the attorney to re-file. 00- Chief Administrative Officer Asmus reported he had, as pre- viously instructed by the Council, checked with the El Monte Office regarding County Aid in relation to the 1911 Act. The County Officer informed Mr. Asmus that kids question had never been discussed at any of their staff meetings with the case workers. The County Officer pointed out that he felt, from a welfare stand- point, their workers would have a right to advise their clients, if asked, what the 1911 Act signatures on a petition might lead them into, inasmuch as they are subjecting that property to a lien and the State does not provide the additional money to meet the expense. The County Officer said he would take it up in the next staff meeting and advise the case workers not to press this matter with the clients, but, if the case workers were asked, they would point out the difficulties, but not in an advisory capacity. 00- Regular Meeting of the Baldwin Park City Council September 15, 1958 Page 7 C.A.0. request for conf. Re: His acceptance of Deposits from Cons.Roofing & Bldg. Sup. and Kraft Homes. Granted. Chief Administrative Officer Asmus gave his report to the Council concerning the Consolidated Roofing and Building Supply and Kraft Homes. He said they were the parties on Arrow High- way who have built on their property and the City required, under the legal opinion of the City Attorney, the installation of curbs, gutters and sidewalks in the jurisdiction of Irwindale. Both parties involved are willing to install the curbs, gutters and sidewalks, however, sufficient plans and specifications and grades are not available at this time. Mr. Asmus said he accepted, on his own authority, from Consolidated Roofing and Building Supply a cash deposit of $500.00 as a guarantee that they would install curbs, gutters and sidewalks when our Engineering Department is able to work out the final details with Irwindale. In the case of Kraft Homes, they are depositing $600.00 to guarantee installation of the curbs, gutters and sidewalks. Mr. Asmus requested confirmation from the Council on his action taken in this matter. Councilman Stephens moved that the Council concur with the action taken by the Chief Administrative Officer in accepting the deposit from the two firms so named. Councilman Littlejohn seconded the motion. Discussion followed. Councilman Holmes said he would like clari- fication and remarked that, in his opinion, the City was getting. more and more involved, reaching the point where the City was not only trying to enforce our ordinance in another city, but was ap- parently expected to hold deposits guaranteeing what the other city would or would not do; that, it appeared to him, the City was becoming involved in what might have legal complications. He requested an opinion on the matter from the City Attorney. Acting City Attorney Gorlick advised that it was the City's ordinance and under that ordinance there is a provision to the effect that if installation of curbs, gutters and sidewalks are not made the party can furnish satisfactory guarantee. He read from the City Ordinance Book and concluded that a deposit was the best thing. City Engineer Young repprted he had obtained plans and profiles on Arrow Highway of the sections in question, and that his depart- ment was attempting to work out with Irwindale what the curb grades will be. Councilman Holmes asked if the City was in a position to give the grades in Irwindale city limits and if the City was actually going to physically make these grades. Chief Administrative Officer Asmus replied that in discussing this problem with Harold Johnson of Irwindale, it was tentatively decided that the City of Baldwin Park, working with the City of Irwindale, would go out and set the proper grades, inasmuch as it is the City's requirement that the curb, gutter and sidewalks be installed. Mr. Asmus said he felt the City was just as justified in setting the grades there as any other location in the City, and that the grades would have to be approved by the City of Irwindale. Mr. Asmus concluded that Mr. Harold Johnson had assured him there would be no difficulty. This purchase, amounting to $416.00 plus tax, was anticipated in the 1958-59 Budget. Councilman Stephens asked if Stockwell and Binny was the only one who could supply the Royal, and if other agents the three in Baldwin Park could supply the. Royal, or, if they had been asked to bid on a typewriter of another make comparable in use. Mr. Asmus replied no, they could not supply the Royal and that it had been determined, from a financial standpoint, it was better to standardize the equipment. Councilman Holmes said there were a number of other machines considered standard machines and asked why an electric machine was necessary and what type of work required an electric machine. Mr. Asmus said the machine would be used in the Planning Depart- ment mainly for stencil cutting. Acting Planning Director Teater explained he believed it would make that department operate more efficiently as the machine would have a long carriage, which is necessary to make graphs and charts. Discussion followed. Councilman Holmes moved that the City call for bids on various brands of electric typewriters and that the bids be brought to the next Regular Council Meeting. Councilman Littlejohn seconded. There were no objections and the motion was so ordered by Mayor Cole. 00- September 15, 1958 Page 8 Chief Administrative Officer Asmus presented a charity request from the Baldwin Park Service Council to sell tickets for a 21 hour, 3-ring, outdoor circus on October 19th, at the Baldwin Park High School football field. The proceeds, 50% of the gross estimated at $3,000.00) will be placed in a trust fund to help build a youth center in Baldwin Park. Mr. Talley, President of the Baldwin Park Service Council, spoke to the Council, requesting waiver of the $50.00 license fee for a circus. Mr. Campuzano also spoke, explaining that the Exchange Club in Covina is having a show at the school, and there is also one being held by the Monrovia Police Department, and in neither case are they being charged for a license. Acting City Attorney Gorlick said it was not a matter of Council discretion, and that the Baldwin Park Service Council should file their application with the Chief Administrative Officer for an exception. Attorney Gorlick said'he would give his opinion on the matter to Mr. Asaus on the following day. Councilman Littlejohn moved that Chief Administrative Officer act according to the City Attorney's opinion, and notify Mr. Talley accordingly. Councilman Stephens seconded. He said that Baldwin Park, as originally laid out, is a problem town", but there is nothing in Baldwin Park that could not be solved with proper study by the Planning Department. He suggested that the Council strongly consider the request. Councilman Bishop concurred with Councilman Stephens as long as applications could still be taken which would not cause too much delay. Councilman Littlejohn told the Council he was not in favor of a moratorium at this time and would like to give it more time and thought.. He inquired about the citizens who obtained loans and the legal aspects involved. City Attorney Gorlick advised that it is up to the Council whether they want to act on a lot split, zone change or variance, there being no legal objections. The City could accept new applications with the understanding that, from the time of ac- ceptance, it would be 30 days before action would be taken on them. After much discussion Councilman Holmes moved that a 30 day moratorium be declared on the processing of new lot splits, effective from September 16 to October 24; that applications will be accepted and the applicant advised that if will be 30 Councilman Littlejohn seconded the motion. The Planning Commission felt that the condition that the applicant dedicate and improve 30 ft. of the northerly property for street and highway purposes is necessary in order that the zone may be used properly. Council agreed there would be no way to put in a 30 foot street without tearing down a house, and that the recommendations now presented by the Planning Commission were practically the same as presented to the Council previously. Acting Planning Director Teater said Mr. Arlotti had voiced the opinion that he did not want to put a street through at this time, that he wanted a 20 foot driveway to build approximately four 5,000 square foot houses; and the Planning Commission did not feel that creating an area on 20 foot drives was the type of development the City wished to have, since other 20 foot drives inthe City have created many problems.
