Councilman Littlejohn lead the salute to the flag. The Invocation was given by Reverend Richard Hetz of the First Presbyterian Church. Roll Call: Present: COUNCILMAN BISHOP, HOLMES, LITTLEJOHN, WILSON AND MAYOR COLE Absent: CITY CLERK BALKUS, CITY ENGINEER YOUNG CITY TREASURER PUGH Also Present: CHIEF ADMINISTRATIVE OFFICER ASMUS, CITY ATTORNEY GORLICK, ACTING PLANNING DIRECTOR TEATER Due to illness, City Clerk Balkus was unable to attend the meeting and at her request Miss Dorothy Leonard was present to serve as her deputy) 00- COUNCILMAN HOLMES MOVED that the Minutes of March 2, 1959 be APPROVED as presented and further reading waived. COUNCILMAN BISHOP SECONDED. There were no objections and the motion carried unanimously and was so ordered by Mayor Cole. 00- Mayor Cole requested that any and all members of the audience who wished to speak at this meeting stand and take the oath. Miss Leonard administered the oath. 00- Reverend Jerry Pedersen, Pastor of the Ascension Lutheran Church 14855 Pacific Avenue, spoke to the Council and requested, on be- half of his congregation, that Council authorize reimbursement for paving 348 ft. In front of the church property at Puente and Pacific Avenues the reimbursement to be at the lowest rate the City has had the work done. Mr. Ray Walker, 3202 North Puente, also spoke in fervor of Reverend Pedersen's request, saying that considering the good the churches did for Baldwin Park he thought the request worthy of Council's serious consideration. Councilman Littlejohn stated that, in his opinion, Council should have City Attorney Gorlick's legal opinion as to the possibilities of spending money In this manner; that the Lutheran Church should supply the City with the amount of their actual costs, and that the City Engineer should figure and submit the lowest price that the City has had on bids for work of this type. Discussion followed. COUNCILMAN HOLMES SECONDED. There were no objections and the motion carri.e,d by the following vote: AYES: COUNCILMAN LITTLEJOHN, HOLMES, BISHOP, WILSON AND MAYOR COLE NOES: NONE ABSENT: NONE 00- Mr. Ralph Roberts, a representative of the Baldwin Park Bible Church located at Merced and Baldwin Park Boulevard, spoke to the Council stating that the church was built prior to incorporation and that they had installed curbs and gutters; however, they did not know they were supposed to make the tie-ins, and requested that this be done at the City's expense. Mr. James Anderson,_3722 Monterey also spoke as a representative of the Baldwin Park Bible Church. It was explained that when the church purchased buildings from the grammar school district and applied for a permit to move the build- ings on the subject property, the.permit was granted subject to the conditions that the buildings be brought completely up to code and that the hook-ups to the existing pavement be.made. A map, now in the City's file, was presented at the time the applicatton for a relocation permit was made by Mr. Stavness, the church representa- tive at that time. The map, with grades listed, approved by the City Engineer, specified that the hook-ups would be made to the existing pavement and also indicated removal of trees, light standards, etc. Mayor Cole suggested that since the church board of trustees had evidently not been properly informed by their representative or seen the map, that they come in at their convenience and the Plan- ning Department would be happy to show them the plot plan and go over it with them. Considerable discussion followed. Former Councilman Edward Stephens, who was on the Planning Commis- sion at that time, stated that he believed that curbs,' gutters, sidewalks and pavement hook-ups were in the Planning Commission Resolution as a condition of the development which was agreed to and signed by Mr. Stavness. COUNCILMAN HOLMES MOVED that the matter be referred to the City Attorney for his legal opinion in the event there is a possibility of legal ramifications. COUNCILMAN LITTLEJOHN SECONDED. Los Angeles Street, stated that he lived directly across the street and the value of his property would depreciate as much or more than any in the locality if the building were not constructed properly or operated properly; however, he was In favor of the construction as the service station had been well operated and he considered it a help and a service to the community. Mayor Cole stated that public hearings on the case had been held and that the matter was on the agenda and would come before Council later in the meeting. A written legal opinion was presented to Council by City Attorney Gorlick which stated that, in his opinion, Councilman Bishop and former Councilman Edward Stephens were eligible to receive wages retroactive since they were elected to City offices. Mr. Gorlick based his opinions on a recent decision handed down in the case of District Attorney William B. McKesson versus the County Auditor for a wage increase. Mr. Gorlick also indicated that newly ap- pointed Councilman Wilson, who replaced Councilman Stephens, may be eligible for pay of $50.00 per month. COUNCILMAN HOLMES MOVED that the City Attorney be instructed to prepare and file a brief to ask the court's decision on the matter. He stated it would not only benefit Baldwin Park, but possibly benefit other cities faced with a similar situation. Former Councilman Edward Stephens requested permission to speak and stated he had talked with approximately 22 attorneys and they all agreed with City Attorney Gorlick's opinion, and he thought the calling for the brief was a stall". He stated he was not going to sue the City but he thought those entitled to pay should get it; that long before he was elected to office the residents of the City, by majority vote, approved paying councilmen $50.00 a month and the Mayor $75.00. Councilman Littlejohn stated he thought the councilmen were en- titled to the money, however, he wanted to be sure it was done in the proper manner to justify the expenditure. Councilman Holmes stated the motion he made was to avoid possible lawsuits and the entailed actions a suit would bring the net results would be just a s conclusive in filing a brief. Discussion continued. City Attorney Gorlick stated the court's decision could be ex- pected within approximately two weeks. COUNCILMAN BISHOP SECONDED THE MOTION. The owners of the Baldy View Trailer-Park also included a list of addresses of trailers parked in back yards in Baldwin Park. Discussion followed concerning the City's ordinance prohibiting the use of trailers being parked in back yards for living quarters and the policy of enforcement of this ordinance. COUNCILMAN WILSON MOVED that the public be notified through the newspapers thirty days prior to the time letters are mailed to the violators; with an additional thirty days before taking further action. COUNCILMAN BISHOP SECONDED. There were no objections; the motion carried unanimously and was so ordered by Mayor Cole. 00- City Attorney Gorlick reported that the Scott--Nusbaum vs City of Baldwin Park hearing was held Monday morning, March 16, 1959 at the Pomona Superior Court. After hearing extensive arguments, Judge William Haughton expressed the opinion he would like to see the City and property owner sign an agreement that the-house would be set back in compliance with, the set-back requirement when a street is developed. COUNCILMAN BISHOP MOVED that Mr. Nusbaum be required to move the house back in compliance with set-back requirements at such time the street is developed, and that the owner of the property be issued a certificate of occupancy upon his execution of the agreement satisfactory to the City Attorney and that the agree- ment be recorded in the County Recorder's Office. COUNCILMAN HOLMES SECONDED. Considerable discussion followed concerning the telephone rates, itemized statements and the possibility of protesting the rates and bulk" billings to the Public Utilities Commission. COUNCILMAN HOLMES MOVED that the City Attorney be instructed to prepare a resolution to be forwarded to the Public Utilities Commission protesting the increase in rates being granted with hearings held only in Los Angeles; and requesting that public hearings be held in each community to give the people an oppor- tunity to testify. COUNCILMAN BISHOP SECONDED. There were no objections and the motion carried unanimously and was so ordered by Mayor Cole. 00- Deputy Clerk Leonard presented an ordinance for second reading. There were no objections and the motion carried by the following vote: March 16, 1959 Page 7 AYES: COUNCILMAN BISHOP, HOLMES, LITTLEJOHN, WILSON AND.MAYOR COLE NOES: NONE ABSENT: NONE 00- I I Councilman Bishop reported that he had attended a special meeting $9,000.00 of the Community Recreation Advisory Board on Tuesday, March 10, AUTHORIZED 1959 to discuss the budget and the after school and summer recrea- for alter tion programs for children which was outlined by Mr. Clint Frazier, school & City Truant Officer and Recreation Director of the eleven element- summer ary schools in Baldwin Park. In the proposed $22,662.60 budget, recreation the district requested $11,000.00 from the City. Mr. Bishop said program. they had been unable to reach an agreement on the amount requested from the City and asked Council to determine the sum the City is able to contribute toward the program. Mrs. Marianne Johnson, 3825 North Foster, spoke in behalf of the recreation program, stressing its importance and stating that it was the City's moral responsibility to continue with it. COUNCILMAN LITTLEJOHN MOVED that, subject to the Council's approval of the program, the City of Baldwin Park authorize the expenditure of $9,000.00 for an after school and summer recreation program, COUNCILMAN WILSON SECONDED. Councilman Bishop stated he thought the winter one hour after school activities and Saturday and holiday recreational programs at the schools should be deleted from the budget and discontinued which would save the City several hundred dollars besides putting more money into a better summer program on school playgrounds. Councilman Holmes concurred with Councilman Bishop and both ex- pressed the opinion the sum of $9,000.00 was too high. Mayor Cole stated that the recreation program, in his opinion, was very essential and the children should be kept in-the play- grounds. The motion carried three to two by the following vote: AYES: COUNCILMAN LITTLEJOHN, WILSON AND MAYOR COLE NOES: COUNCILMAN BISHOP AND COUNCILMAN HOLMES ABSENT: NONE 00- Mayor Cole announced that he officially appointed Councilman Bishop Councilman and Councilman Wilson to continue as members of the Community Bishop & Recreation Advisory Board and that. Res. 394, a request by George Boardman for a zone exception at the southwest corner of Bresee Avenue and Los Angeles Street. Mr. Teeter explained the findings of the Planning Commission and that they recommended approval of the zone exception subject to the conditions outlined in P.C. Res. No. 394. COUNCILMAN WILSON MOVED that the findings of the City Council concur with the findings and recommendations of the Planning Commission and the zone exception be granted subject to the conditions outlined In P.C.
