The City Council of the City of Baldwin Park met in adjourned
regular session at the above place at 7:30 P.M.
Councilman Holmes lead the salute to the flag.
Roll Call: Present: COUNCILMAN BISHOP, HOLMES,

COUNCILMAN HOLMES MOVED that the APPROVAL OF THE MINUTES be
WAIVED UNTIL THE NEXT MEETING. COUNCILMAN BISHOP SECONDED.
The motion carried by the following vote:

COUNCILMAN BISHOP MOVED that the meeting ADJOURN to ROOM
#10, the North Social Room. COUNCILMAN WILSON SECONDED.
There was no objection, the motion carried and it was so
ordered by Mayor Cole.
Mr. Doyle T. Lackey, 14553 E. Chevalier Avenue, Baldwin Park,
asked for clarification of certain policies so they could
proceed in their areas with certain street improvements and
questioned if they would be permitted to extend the pavement
from the 20' that has been agreed upon by the City over to
the existing sidewalks which would involve 51' on each side.
He stated that they knew that curbs and gutters were far
superior to any other type of street work, but in this area
with the financial inability of the people to pay for curbs
and gutters, they felt that the rolled paving would be the
next best thing. He further stated that the people who were
financially able, wanted to go ahead and do this work now
while the contractor was in the area.
City Engineer Young reported that under the terms of the
present ordinance, each one of those individuals could take
out a permit and pint in black top from the existing pavement
to the sidewalk, or in driveways. To do this street as one
project would require establishing additional grades to those
we now have and this would leave a few waves in the paving when
said paving connects the existing paving with the sidewalk as
it now exists.
There was discussion by Council.
COUNCILMAN HOLMES MOVED that Council instruct the City Engineer
to confer with these people and to assist them in the project
that they may want to develop to establish satisfactory grades
on this street. COUNCILMAN BISHOP SECONDED. The motion carried
by the following vote:

City Clerk Balkus presented and read a statement from Fry & Fry
Inc. on partial completion of the remodeling of the Police
Department Facilities, in the amount of $5,330.70. COUNCILMAN
BISHOP MOVED that partial payment in the amount of $5,330.70 be
APPROVED. COUNCILMAN HOLMES SECONDED. The motion carried by
the following vote:

Mayor Cole reminded Council of the Seventh Annual Membership
Dinner meeting of Inter-Community Hospital Association on
October 21, 1959, at 7:00 P.M. at The Palms in Glendora.

Mayor Cole asked Councilman Holmes to represent the City at
the meeting of representatives for the World's Fair to be
held at the Dinnerhorn in Pomona, Tuesday, October 20, 1959•,
at 7:00 P.M. Councilman Holmes accepted.

Mayor Cole announced it was 8:00 o'clock P.M. and the time
and place for Public Hearing on a request of Harld and
Louise Hopkins, and Ruth Smith, 1707 East Bay Avenue, Balboa,
California, and Leaseholder Aloys Cailiier, 520 West 109th
Street, Los Angeles, California, for a special permit to
mine rock aggregates on property south of Olive Street, north
of Los Angeles Street, and east of Rivergrade Road.
Mayor Cole requested Planning Director Teater to locate and
describe the property involved.
Planning Director Teater described the outlines of the subject
property.
Mr. Frank J. Kashare, 215 West Seventh Street, Los Angeles
14, California, Attorney for the applicants, presented
their case, offering exhibits which included an aerial
photo of the property, a plot plan, a letter from Robert G.
Lunche, Acting Assistant Director of Engineering of the Air
Pollution Control District, County of Los Angeles, together
with the Rules and Regulations, Chapter 2, Division 20 of
the Health and Safety Code of the State of California, and
21 photographs of the property immediately east of applicant's
property.
Witnesses for the applicant, as introduced by Mr. Kashare
were as follows:
Mr. C. Harold Hopkins, 1707 E. Bay Avenue, Balboa, California,
owner of the property, together with his wife, Louise Hopkins,
and her sister, Ruth Smith Hopkins.

Mr. Aloys Caillier, 520 West 109th Street, Los Angeles,
California, lessee of Mr. Hopkin's property and person who
desires to put in a rock-crushing plant and mine the area.
Mr. Tyler Suess, 5037 Magnolia, Riverside, California,
Planning Director for the County of Riverside, who presented
a brief resume of his working experience and expressed his
professional opinions regarding operation of rock crushing
plant and its effects.
Mr. John Q. Jewett, Civil Engineer, associated with the firm
of Leeds, Hill and Jewett, 609 South Grand, Los Angeles,
California, who presented a brief resume of firm's civil
engineering activities and expressed his professional opinion
regarding the physical effects of operating a rock crushing
plant, touching particularly on the location and condition
of the wells in this particular area.
Witnesses for the opposition were as follows:
Mr. Vince Stowell, 13323 East Demblon Street, Baldwin Park,
California, resident of the area involved and industrial
Supervisor of the Minneapolis Honeywell Regulator Company,
who refuted statements, in general, that were made by witnesses
for the applicant.
Mr. C. A. Spooler, 14083 E. Olive, Baldwin Park, California
stated that a petition with 175 signatures of property owners
in the area under discussion had been presented protesting
this program.
Mr. Roy Aday, 4518 North Hornbrook, Baldwin Park, California,
protested the photographs as presented by the applicant for
exhibit.
Mr. Morris D. Coppersmith,. 4516 Petit Avenue, Encino, Calif-
ornia, Attorney, stated he had been solicited by residents
of the area involved to represent their interests and who
asked rejection of the installation of a rock crushing
plant because of the general detrimental effect on the
citizens. Mr. Coppersmith stated he was indirectly interested
as he has an equity in seventeen 17) homes on Dunia Street.
Mr. Albert M. Gilmore, 4454 North Harlan, Baldwin Park, Calif-
ornia, Registered Engineer, associated with the California
Institute of Technology, who protested particularly, the
effects of the dust from the operation of a rock crushing plant.
Mr. Joseph Balkus, 4625 North Harlan, Baldwin Park, California,
refuted statements made by witnesses for the applicants and
protested, in general, the effects that would be suffered by
residents of the area if a rock crushing plant were permitted
to operate.
Mrs. Emily Stowell, 13323 East Demblon, Baldwin Park, California,
protested the permission of a rock crushing plant as it would be a
detriment to the beautification and general welfare of the City of
Baldwin Park.
Mr. Harry Shier, 13305 Rockenbach Street, Baldwin Park, California,
protested, generally, the installation and effects of a rock
curshing plant.
Mr. William B. Alexander, 4560 Hornbrook Avenue, Baldwin Park,
California, opposed a gravel pit being permitted to operate due
to being a detriment to general welfare and health of citizens
and that it would lower property values.

Carolea Fowler, 4547 North Hornbrook, Baldwin Park, Calif-
ornia, questioned thezoning of the property in question..
Mrs. Marianne Johnson, 3825 North Foster, Baldwin Park,
California, questioned ingress and egress on subject
property and protested permission of the operation of a
rock crushing plant.
Mr. James Picarro, 13307 E. Los Angeles Street, Baldwin
Park, California, who questioned whether the subject
property had ever been a proposed freeway.
The following citizens came forward and stated they were
in opposition to the operation and gave their reasons for
objecting.

there was questioning of applicant's witnesses and general
discussing.
COUNCILMAN LITTLEJOHN MOVED that this HEARING BE CONTINUED
UNTIL DECEMBER 10, 1959, at 7:30 P.M. IN THE COUNCIL
CHAMBERS, for the following reasons.... that there has been
indicated a need for professional or expert advice for the
number of technical problems Involved in this case; also
instruct the City Clerk to prepare a transcript of tonight's
hearing; and also, if necessary, to secure any professional
services on the technical problems raised by tonight's pro-
ceedings subject to specific approval of the City Council.

Councilman Holmes questioned the Chief Administrative
Officer as to when Council would be receiving information
on the sewers from the sewer consulting firm of J. B.
Hanauer & Company. Chief Administrative Officer Asmus
stated he had contacted the consulting firm the past
Thursday and was informed that they had been extremely
busy but would have the information within ten days.
Councilman Littlejohn reported that a matter of a proposed
annexation to the City of Baldwin Park had apparently not
been brought to the attention of the City Engineer; that
it was located off Bess Avenue and Baldwin Park Blvd.; and
that the people were anxious to annex to the City of
Baldwin Park and interested in an M-1 zone for establishing
a large lumber and window processing plant.
Planning Director Teater stated that proper forms to
file for annexation had been Issued but had not, as yet,
been presented for action. Curbs, gutters and sidewalks
would be required under the present ordinance.

Chief Administrative Officer Asmus stated that the question
involved here was the city's policy on curb, gutter and side-
walk requirements.
Mayor Cole suggested that the Chief Administrative Officer
and the Planning Department get all the necessary information
and bring back to the Council so they can act upon it.
At 12:05 A.M. COUNCILMAN HOLMES MOVED that Council ADJOURN.
COUNCILMAN BISHOP SECONDED. There were no objections, the
motion carried and was so ordered by Mayor Cole.
