HomeMy WebLinkAboutORD 1476ORDINANCE NO. 1476 AN ORDINANCE OF THE PEOPLE OF THE CITY OF BALDWIN PARK, CALIFORNIA, AMENDING SECTION 30.02 TO CHAPTER 30 OF TITLE 3 (ADMINISTRATION) OF THE BALDWIN PARK MUNICIPAL CODE REGARDING CITY COUNCIL REORGANIZATION WHEREAS, the City of Baldwin Park is a general law city incorporated under the laws of the State of California; and WHEREAS, California Government Code Section 34902(b) establishes the procedure to eliminate the elective office of mayor after the office has been established; and WHEREAS, if a majority of the votes cast on the proposition are in favor of the elimination of the office of elective mayor, the office shall be eliminated on the expiration date of the incumbent's term, and on the date the procedure of selection of the mayor by the city council shall be established. NOW, THEREFORE, THE PEOPLE OF THE CITY OF BALDWIN PARK DO HEREBY ORDAIN AS FOLLOWS: Section 1. The recitals above are true and correct and incorporated herein by reference. Section 2. Section 30.02 (Council Reorganization) is hereby added to Chapter 30 (City Council) of Title 3 (Administration) of the Baldwin Park Municipal Code to read as follows: Section 30.02 — Council Reorganization The Council shall reorganize and select one of its number as Mayor and Mayor Pro Tempore, on the following occasions commencing in 2024: A. In odd even -numbered years at the Council meeting at which the canvass of the results of the general municipal election are declared. B. In even odd -numbered years at the first regular meeting conducted in the month of December. C. At such other times as a majority of the City Council shall order. D. This section shall not be amended or repealed except by a majority vote of the voters of the City of Baldwin Park at a regularly scheduled election. Section 3. Severability. If any provision of this ordinance or the application thereof of any person or circumstance is held invalid, the remainder of the ordinance and the application of such provision to other persons or circumstances shall not be affected thereby. Section 4. Effective date. This Ordinance shall become effective immediately upon the following conditions: (1) approval by the City Council; (2) approval of the Ordinance by majority of the voters casting votes at the General Municipal Election of November 8, 2022; (3) certification of all votes cast by the City Council confirming that a majority of the voters have approved this ordinance; and (5) confirmation of approval of this Ordinance by the City Council upon certification of election results. Section 5. The City Clerk shall timely cause the same to be published once in a newspaper of regular circulation. The Ordinance shall become effective immediately upon the certification of an affirmative majority of the electors of the City in favor of eliminating the directly elected mayor at the November 8, 2022, General Municipal Election.
