Estrada Councilm ember Manuel Lozano CALL TO ORDER The meeting was called to order at approximately 7: 10 p.m. by Mayor Avila. INVOCATION The invocation was given by Pastor Flores and Pastor Jackson. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilmember Manuel Lozano. ROLL CALL City Clerk Saenz performed roll call: MEMBERS: Council Member Jean M. Estrada (present) Council Member Manuel Lozano (present) Mayor Pro Tern Daniel Damian (present) Mayor Alejandra Avila (present) REPORT FROM CLOSED SESSION City Attorney Tabares announced that the City Council met in closed session on the item listed on the Special meeting Agenda, all the members were present. On Items to update was given and there is no reportable, on Item lb direction was given and there is no reportable action, on Items 2 and 3 there is no reportable action. ANNOUNCEMENTS City Attorney Tabaras announced there is an agenda item (6a) that is being requested to be added by the Director of Recreation & Community Services on the Consent Calendar for approval of agreement with Learning Enrichment After School Programs dba Leap for the Summer Lunch Program. This item came to the attention to staff after the agenda was published and the reason was that there was an uncertainty surrounding the funding for the program from State and Federal sources. There was an imminent deadline that requires approval of this item this evening per Government Code Section 54594.2 (b)(2), the Council needs to make a determination by a two-thirds vote. MOTION was made to take immediate action and the need for action came to the attention of the agency after the agenda was posted by Manuel Lozano and seconded by Emmanuel J. Estrada. Passed [5-0] AYES: AYALA, ESTRADA, LOZANO, DAMIAN, AVILA PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS The Mayor and the City Council proclaimed May 2025 as Older Americans Month proclamation was presented to Rosalinda Sally G Ong, a 2025 Older American Citizen of the Year Honoree. 05-07-2025 Regular Meeting Minutes Page I of 5 The Mayor and City Council presented to Rosalinda Sally G Ong the 2025 Senior of the Year Plaque. The Mayor and City Council presented a plaque to Sensei Tony Mojica for receiving the California Parks and Recreation Society District 13 "Best of the Best" Awards — Community Hero Award. CPRS former President Kyla Brown, CPRE presented the California Parks and Recreation Society (CPRS) - Creating Community Award of Excellence Economic Vitality — Summer Concerts & Downtown Street Market to the Department of Recreation and Community Services. The Mayor and City Council proclaimed May 4 — 10, 2025 as Professional Municipal Clerks Week proclamation was presented to Christopher Saenz, City Clerk and Shirley Quinones, CMC, Chief Deputy City Cleric. PUBLIC COMMUNICATIONS The Mayor opened Public Communications at approximately 7:50 p.m., the following spoke: 1) Julie 2) Abel 3) Marlon 3)Teresa Tapia Seeing no one else wishing to speak, motion to close public communications. Passed [5-0] CONSENT CALENDAR City of Baldwin Park's Warrants and Demands Motion to ratify the attached Warrants and Demands Register. Meeting Minutes of April 16, 2025 Motion to approve the following meetings minutes of the Special City Council Meeting, Regular City Council Meeting, Finance Authority Meeting and the Housing Authority Meeting held on April 16, 2025. MOTION: It was moved by Manuel Lozano, seconded by Jean M Ayala to adopt motion. Passed [5-0] AYES: AYALA, ESTRADA, LOZANO, DAMIAN, AVILA Resolution No. 2025-006 Initiating the Proceedings and Ordering Preparation of the Engineer's Report for the Parks Maintenance Assessment District for FY2025-2026 Motion to adopt Resolution No. 2025-006entitled, "A Resolution of the City Council of the City of Baldwin Park, California, authorizing the initiation of the proceedings and ordering the preparation of the Engineer's Report for the FY 2025-2026 levy of annual assessments for the Parks Maintenance Assessment District pursuant to the provisions of Division 15, Part 2 of the State of California Streets and Highways Code." Resolution No. 2025-007 Initiating the Proceedings and Ordering Preparation of the Engineer's Report for the Citywide Landscape and Lighting Maintenance Assessment District for FY2025- 2026 Motion to adopt Resolution No. 2025-007 entitled, "A Resolution of the City Council of the City of Baldwin Park, California, authorizing the initiation of the proceedings and ordering the preparation of the Engineer's Report for the FY2025-2026 levy of annual assessments for the City of Baldwin Park Landscaping and Lighting Maintenance District pursuant to the provisions of Division 15, Part 2 of the State of California Streets and Highway Code." MOTION: It was moved by Manuel Lozano, seconded by Jean M Ayala to adopt motion. Passed [5-0] AYES: AYALA, ESTRADA, LOZANO, DAMIAN, AVILA Request for Appropriation of Funds for Underground Waste Oil Tank Abandonment and Concrete Deck Repair at Clarifier City Yard Facility Motion to: 1. Authorize the Director of Finance to reappropriate $23,830.00 within Fund #402 — Fleet Services and appropriate $21,780.00 to Fund #245 — Proposition C for FY 2024/2025 to cover a total of $45,610.00 in repair costs; and 2. Authorize the Director of Finance to make necessary budget adjustments to allow payments; and 3. Authorize the Acting Director of Public Works, or his designee, to complete all the proper documentation to process purchase requisition for selected vendors, Premiere Fueling Services Inc. for underground waste oil tank removal in an amount -not -to exceed $23,830.00 and Sager Construction Inc. for surrounding concrete repairs in an amount -not -to exceed $21,780.00. Passed [5-0] AYES: AYALA, ESTRADA, LOZANO, DAMIAN, AVILA Approve and Adopt Resolution No. 2025-009 Approving the Industrial Disability Retirement (IDR) for William Zendejas a Local Safety Member Motion to adopt and approve Resolution No. 2025-009 entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, APPROVING THE INDUSTRIAL DISABILITY RETIREMENT (IDR) FOR WILLIAM ZENDEJAS A LOCAL SAFETY MEMBER". Approval of Agreement with Learning Enrichment After School Program, Inc. (dba Leap) for the Summer Lunch Program Motion to: 1. Authorize the Mayor to execute a one (1) year service agreement with Learning Enrichment After - School Program, Inc. (dba Leap); and 2. Authorize Director of Recreation & Community Services to execute any associated documents; and 3. Authorize Director of Finance to appropriate funding and make necessary changes to the budget. Passed [51-0] AYES: AYALA, ESTRADA, LOZANO, DAMIAN, AVILA 05-07-2025 Regular Meeting Minutes Page 3 of 5 REPORTS OF OFFICERS Final Feasibility Report for Grade Separation at Ramona Blvd and Metrolink Railroad Charles Tsang, P.E. T.E., Senior Director, Regional Rail - L.A. Metro, Program Management gave a presentation Motion to: 1. Receive and file the Technical Feasibility Report for the Ramona Blvd/Metrolink Railroad Grade Separation, also known as Project Study Report Equivalent (PSRE), attached herein. 2. Acknowledge that the grade separation is technically feasible at an estimate cost of $167.9 million over an eight -year period with 2025 as the base year. 3. Direct Staff to pursue project development partnerships with LA Metro, Metrolink, Caltrans, SGV Council of Governments and others. 4. Direct Staff to pursue funding grants with the county, state, and federal agencies enlisting the support of our elected officials. 5. Thank LA Metro and its project team for undertaking the preparation of the feasibility analysis. MOTION: It was moved by Emmanuel Estrada, seconded by Manuel Lozano to adopt motion. First Reading and Introduction of an Ordinance No. 1513 to Amend Sections 153.040.070, 153.070.020, 153.120.350, 153.120.360 and 153.120.370 of the Baldwin Park Municipal Code Relating to Accessory Dwelling Units and Junior Accessory Dwelling Units and Finding the Action to be Statutorily Exempt from CEQA Motion to continue this item to a date uncertain. Public Hearing was open at 8:46 p.m., seeing no one wishing to speak public hearing was closed. MOTION: It was moved by Daniel Damian seconded by Manuel Lozano to adopt motion. Appeal of the Planning Commission's Decision to approve a Conditional Use Permit to allow a recreational facility (indoor/outdoor soccer facility) use, and a Design Review Application, and finding that the proposed project is categorically exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines section 15332, Class 32 — Infill Development. (Location: 14412 & 14424 Joanbridge Street; Applicant: Trinidad Campbell; Case Number: CP 23-05, PR 23-21). Motion to : 1. Adopt Resolution No. 2025-008 DENYING THE APPEAL AND UPHOLDING THE DECISION OF THE PLANNING COMMISSION OF THE CITY OF BALDWIN PARK AND APPROVE A CONDITIONAL USE PERMIT TO ALLOW RECREATIONAL FACILITY (INDOOR/OUTDOOR SOCCER FACILITY) USE, AND A DESIGN REVIEW APPLICATION. (LOCATION: 14412 & 14424 JOANBRIDGE STREET; APPLICANT: TRINIDAD CAMPBELL; CASE NUMBER: 05-07-2025 Regular Meeting Minutes Page 4 of 5 CP 23-05, PR 23-21), AND FINDING THE PROPOSED PROJECT IS CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO STATE CEQA GUIDELINES SECTION 15332" with the amendments.
