HomeMy WebLinkAboutResolution No. 2025-027 - Accepting Tabacco Grant Program Funds - DOJ-PROP56-2023-24-1-003Docusign Envelope ID: 9EC81DB6-7C3E-49ED-893D-042453B99136 RESOLUTION NO. 2025-027 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ACCEPTING GRANT FUNDS AND ENTERING INTO A MEMORANDUM OF UNDERSTANDING (MOU) WITH THE STATE OF CALIFORNIA'S DEPARTMENT OF JUSTICE FOR THE TOBACCO GRANT PROGRAM (DOJ-PROP56-2023-24-1-003) WHERAS, the State of California, Department of Justice (DOJ) has awarded grant funding from the Tobacco Grant Program, which is made available through the California Healthcare, research and Prevention Tobacco Tax Act of 2016 (Prop 56) (DOJ) to support local efforts to reduce the illegal sale of tobacco products to minors in the city; WHEREAS, following the City's submittal of a proposal for the Program, the State of California DOJ has awarded the City of Baldwin Park grant funding in the amount of $225,228 for overtime and administrative costs related to tobacco enforcement operations, personnel training, tobacco retailer inspections, equipment cost, and travel expenses; WHEREAS, to be eligible for grant funding, the City must submit a completed and executed Grant Award Memorandum of Understanding to the State of California DOJ; and WHEREAS, the City Council of the City of Baldwin Park seeks to accept the grant funds to enhance resident safety through the enforcement of local tobacco regulations, including flavored tobacco bans and sales restrictions to minors. NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BALDWIN PARK, AS FOLLOWS; SECTION 1. The Chief Executive Officer or a designated representative is hereby authorized, on behalf of the city, to accept grant funding in the amount of $225,228 from the State of California DOJ. SECTION 2. The Chief Executive Officer or a designated representative is hereby authorized, on behalf of the City, to execute a three-year Memorandum of Understanding with the State of California DOJ. SECTION 3. The Chief Executive Officer or a designated representative is hereby authorized and directed, on behalf of the city, to execute the grant documents and submit such documents, including, without limitation, contracts, amendments, extensions, and payment requests as appropriate to accept the funds under and comply with the conditions of the grant. SECTION 4. The Chief Executive Officer is hereby authorized and directed to establish all required accounts and make any and all expenditures, appropriations, transfer, and/or distributions of funds on behalf of the City as necessary and appropriate to carry out the purpose and intent of this resolution. SECTION 5. Grant funds received hereunder shall not be used to supplant on going law enforcement expenditures.
