A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN
PARK APPROVING A SPECIFIC PLAN AND A DEVELOPMENT PLAN
TO ALLOW THE CONSTRUCTION OF A THREE-STORY, 75-UNIT
FEDERALLY SUBSIDIZED SENIOR CITIZEN APARTMENT
BUILDING APPLICANT: TELACU INDUSTRIES; LOCATION: 3834
MONTEREY AVENUE, 13600 and 13626 RAMONA BOULEVARD;
CASE NO.: SP 98-1 AND DR-i 0).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin Park does hereby find,
determine, and declare as follows:
a) That applications Applications") for a Specific Plan and a Development
Plan were submitted on behalf of the owners of certain real property, located at 3834
Monterey Avenue and 13600 and 13626 Ramona Boulevard in the City of Baldwin Park,
described more particularly in the Applications on file with the City Planner; and
b) That the Specific Plan and Development Plan are requesting approval to
allow the construction of a 75-unit federally subsidized senior citizen apartment building
pursuant to Government Code Section 65450; and
c) That on July 22,1998, a duly noticed public hearing was held on said
Applications by the Planning Commission, and based upon evidence presented including
applicable staff reports and each member of the Commission being familiar with the
properties, the Planning Commission recommended that the City Council approve the
Specific Plan and Development Plan; and
d) That a duly noticed public hearing was held on said Applications by the
City Council, and based upon evidence presented including applicable staff reports and
each member of the Council being familiar with the properties, it was determined that the
facts as required by the Baldwin Park Municipal Code for the granting of such
Applications are present and that the Specific Plan and Development Plan should be
approved.
SECTION 2. That Specific Plan, as herein described be, and the same hereby is
approved, and that the Development Plan as herein above described be, and the same hereby is
approved subject to the following conditions:
a) That the Subject Property shall be developed and maintained in
substantial compliance with Exhibit B", dated August 19,1998; and
b) That the applicant shall submit a colors and materials board to the
Planning Division for review and approval; and
c) That a landscape and irrigation plan must be submitted for review and
approval to the Planning Division prior to the acceptance of building construction plans for
Plan Check. Once installed, all landscaping must be continually maintained and
preserved in accordance with the approved landscape and irrigation plan. No trees shall
be removed without good cause, and only with prior written approval by the Planning
Division; and

d) That at least three units are to be designed and equipped to
accommodate persons with hearing impairments; and
e) That five percent 5%) of the privately funded apartment house dwelling
units are required to be accessible; four of the 75 units must comply with the requirements
for repositionable counters, accessible bathrooms, etc. Those units that are to be
handicapped adaptable units must be noted on the construction plans; and
f) That the following information must be provided upon the plan check
submittal:
i) Three sets of Architectural plans and one extra site plan for the
Fire Department; and
ii) Three sets of plans for the City; and
iii) Two sets of the following are required:
a. Soils reports
b. Structural calculations
C. Title 24 energy calculations
d. Mechanical, electrical and plumbing plans.
g) That double paned glass be installed in all of the windows of the units;
and
h) A Parcel Map will be required to combine the three lots; and
i) A grading plan, prepared by a registered Civil Engineer, shall be
submitted for review and approval by the Engineering Division; and
j) That all damaged sidewalk portions shall be removed and replaced; and
k) That the applicant shall reconstruct the substandard handicap ramp; and
I) All driveway approaches not being utilized must be replaced with full
height curbs and sidewalk; and
m) That street trees must be planted 50 feet apart along the frontage of the
entire project; and
n) All overhead utilities must be placed underground; and
o) A drainage study must be submitted to for review and approval to the
Engineering Division; and
p) Fire flow required from public hydrants of 5,000 g.p.m. for 5 hours must
be provided; and
q) Fire sprinkler system plans must be submitted to the Los Angeles County
Fire Department, Fire Prevention Engineering prior to installation; and
r) Submit full architectural plans to the Los Angeles County Fire
Department, Fire Prevention Engineering; and

s) That the applicant shall adhere to all mitigation measures set forth in the
adopted Mitigated Negative Declaration; and
t) That the applicant shall submit to the Planning Division within ten 10)
days of this approval of this resolution, as check in the amount of $25.00 made out to the
Los Angeles County Clerk for the filing of the Department of Fish and Game Fee
Exemption; and
u) That the applicant shall comply with all conditions of approval within one
1) year of the effective date of the City Council resolution or the approval of DR-b will
be subject to revocation. Any cost associated with the revocation of DR-b shall be paid
by the applicant and/or owner; and
v) That the applicant shall sign a notarized affidavit within thirty 30) days of
the date of this resolution stating that the applicant has read and accepts all of the
conditions of approval.
SECTION 3. That the City Council at the time of the public hearing on the above matter
reviewed and considered the proposed Mitigated Negative Declaration of Environmental Impact. That the
City Council, based upon its public review, does hereby find that said Mitigated Negative Declaration has
been prepared and was considered pursuant to the provisions and guidelines of the California
Environmental Quality Act, and hereby adopts the Mitigated Negative Declaration since there is no
substantial evidence that the project will have a significant impact on the environment.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution and forward
a copy hereof to the Secretary of the Planning Commission and the Applicant.
