HomeMy WebLinkAboutORD 823ORD 823pT3(ÌìÒÇORDINANCE N0.823 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALDWIN PARK MUNICIPAL CODE RELATING TO THE R-l, SINGLE FAMILY RESIDENTIAL ZONE REGULATIONS. CASE NO. AZC-81). URGENCY) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS; SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows a) That the Government the Health and of the laws of on July 1, 1981, Section 65852.3 of Code and Section 18300, as amended, of Safety Code, enacted by Chapter 1142 1980, will become effective; and b) That said sections require a mobile home, manufactured and certified under the National Mobile- home Construction and Safety Standards Act of 1974, when installed on a foundation system, to be treated similarly to a conventionally built single family dwelling; and c) That the State law allows cities to impose development standards on such mobile homes, provided that such requirements apply to conventionally built single family dwellings; d) That the public interest, convenience and necessity require the establishing of zoning regula- tions relating to such mobilehomes, which must be made effective on or before July 1, 1981. SECTION 2. That Section 9100 of the Baldwin Park Zoning Code is hereby amended by the addition of the following definitions: 9100. Definitions. F.8. M.7. M.8. Factory-Built Housing shall mean a unit which is either wholly or mainly manufactured at an offsite location and is assembled onsite. Factory-Built Housing does not include a mobilehome, mobile accessory building or structure, or an automobile trailer or recreational vehicle, Manufactured Housing shall mean both mobile- homes and factory-built housing. Mobilehome shall mean a structure transport- able in one or more sections, and, which is built on a permanent chassis, and designed to be used as a dwelling with or without a permanent and continuous foundation, when connected to the required utilities and BIB] 37960-U01 ORD-U02 823-U02 LI2-U03 FO4404-U03 FO32704-U03 DO32699-U03 C5-U03 ORDINANCES-U03 12/4/2003-U04 ROBIN-U04 ORD 823pT3(ÌìÒÇUrgency Ordinance No. 823 includes the air-cond itioning electrical, heating, and plumbing systems contained therein." SECTION 3, That Section 9513 of the Baldwin Park Zoning Code is hereby amended by the addition of the following: 9513. Development Standards. G. Minimum Dwelling Unit Width. Each one family dwelling shall have and maintain a minimum width of not less than twenty 20) feet exclusive of any appurtenant structures. H. Exterior Siding. Every one family dwelling shall have and maintain exterior siding of brick, wood, stucco, concrete or other similar material, provided that reflective, glossy, polished metal siding is prohibited. I. Roofing Material. Every one family dwelling shall have and maintain a roof constructed with woodshake, shingle, asphalt composition, or other similar roofing material, provided that reflective, glossy, polished metal roofing is prohibited. J. Eaves. Every one family dwelling shall have and maintain an eave projection of not less than eighteen inches 18") on at least two opposing sides." SECTION 4. That subsection 2 of Section 9511 of the Baldwin Park Zoning Code is hereby amended to read as follows: 9511. Mobilehomes and Modularhomes. 2. One mobilehome per lot, provided: a. the mobilehome has been constructed and/or purchased new on or after October 1, 1976, and is certified pursuant to the National Mobile Home Construction and Safety Standards Act of 1974; and b. the mobilehome is installed and maintained on a permanent continuous exterior masonry or concrete foundation." SECTION 5. That this Ordinance is hereby declared to be an urgency measure, and shall take effect immediately upon its adoption. A statement of facts constituting its urgency is as above set forth. SECTION 6.
