HomeMy WebLinkAboutORD 824ORD 824pT3(ÌìÒËORDINANCE NO. 824 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALCWIN PARK MUNICIPAL CODE RELATING TO THE R-l, SINGLE FAMILY RESIDENTIAL ZCNE PECULATIONS. CASE NO. AZC-81) THE CITY COUNCIL OF THE CITY OF BALCWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the city Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) lhat on July 1, 1981, Seciton 65852.3 of the Government Code and Section 18300, as amended, of the Health and Safety Code, enacted by Chapter 1142 of the laws of 1980, will become effective; and b) That said sections require a mobile home, manufactured and certified under the National Mobile- home Construction and Safety Standards Act of 1974, when installed on a foundation system, to be treated similarly to a conventionally built single family dwelling; and c) that the State law allows cities to impose development standards on such mobilehones, provided that such requirements apply to conventionally built single family dwellings; d) That the public interest, convenience and necessity require the establishing of zoning regula- tions relating to such mobilehcrnes, which must be made effective on or before July 1, 1981. SECTION 2. That Section 9100 of the Baldwin Park Zoning Code is hereby amended by the addition of the folloving definitions: 9100. Definitions. F.8. Factory-Built Housing shall mean a unit which is either wholly or mainly manufactured at an off site location and is assembled onsite. Factory-Built Housing does not include a mcbilehcme, mobile accessory building or structure, or an autoncbile trailer or recreational vehicle. M.7. Manufactured Housing shall mean both mobile- hcares and factory-built housing. M.8. SECTION 3. That Section 9513 of the Baldwin Park Zoning Code is hereby anended by the addition of the following: 9513. Development Standards. G. Minimum Dwelling Unit Width. Each one family dwelling shall have and maintain a minimum width of not less than twenty 20) feet exclusive or any appurtenant structures. H. Exterior Siding. Every one family dwelling shall have and maintain exterior siding of brick, wood, stucco, concrete or other similar material, provided that reflective, glossy, polished metal siding is prohibited. I. Roofing Material. Every one family dwelling shall have and maintain a roof constructed with woodshake, shingle, asphalt composition, or other similar roofing material, provided that reflective, glossy, polished metal roofing is prohibited. m E^es-l Every one family dwelling shall have and mintain an eave projection of not less than eighteen inches 18") on at least two opposing sides." SECTION 4. That subsection 2 of Section 9511 of the Baldwin Park Zoning Code is hereby amended to read as follows: 9511. Mpbilehomss and Mpdularhones. 2. One mcbilehome per lot, provided: a. the mobilehcrne has been constructed and/or purchased new on. or after October 1, 1976, and is certified pursuant to the National M±>ile Hcne Construction and Safety Standards Act of 1974; and b. the mdbilehcrne is installed and maintained on a permanent continuous exterior masonry or concrete foundation." SECTION 6. That the City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner prescribed by law.
