ZONE CHANGE CASE NO. Z-433. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1 That notwithstanding the provisions of Section 9310 of the Baldwin Park Municipal Code, that certain real property located in the City of Baldwin Park, County of Los Angeles, State of California, more particularly described as property located at 3655 Big Dalton Avenue Book 8438, Page 18, Parcels 22, 23, and 25 excepting the southerly 185 feet of Parcel 25, of the County Assessor's Records). be, and the same hereby is rezoned conformance with the General Plan, amend the Official Zoning Map" of to reflect such change. from R-l to R-l PD) in and the City Planner shall the City of Baldwin Park SECTION 2 That the City Council, at the time of the public hearing relating to the zone change. That the City Council does hereby find as follows: a) That the proposed zone change is not contrary to the spirit and intent of the General Plan or its elements. b) That the properties involved in the proposed zoning are more suitable for the purposes permitted in the proposed zone than for the purposes permitted in the present zone. c) That the use permitted by the proposed zone is not detrimental to surrounding properties. d) That the proposed zone change is a logical and rational classifica tion of the land. e) That the proposed development is not contrary to the spirit and intent of the Planned Development Ordinance. SECTION 4. That the City Council does hereby adopt the following conditions: a) That the property be developed as shown on Exhibit A" dated March 24, 1982. b) That the applicant shall provide to the City Planning Division, within thirty days of the effective date of City Council adoption, revised site plans to include the type, and size of all on-site exterior lighting, and proposed amenitites for the recreation area, and revised landscape plans noting those existing trees to be saved and additional landscaping throughout the project. c) That a subdivision map be submitted as required by the City with the proposed Covenants, Conditions and Restrictions for review and approval. d) That the applicant sign a notarized affidavit within fifteen 15) days after the adoption of the resolution that the applicant has read all the conditions of approval. e) That the subject development shall be enclosed with a six 6) foot masonry wall.
