HomeMy WebLinkAboutORD 846ORD 846ÜÂh£ŸjìÓ+ORDINANCE NO. 846 AN ORDINANCE OF THE CITY COUNCIL OF TFfE CITY OF BALDWIN PARK AMENDING TFTE ZONING OF SAID CITY, REZONING CERTAIN HEREIN DESCRIBED REAL PROPERTY, AND APPROVING DEVELOPMENT OF A THIRTY-ONE 31) UNIT RESIDENTIAL CONDOMINIUM PROJECT. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That notwithstanding the provisions of Section 9310 of the Baldwin Park Municipal Code, that certain real property located in the City of Baldwin Park, County of Los Angeles, State of California, more particularly described as property generally located In the 4300 Block of Center Street as follows: Book 8546, Page 24, Parcels 2,3 and 25 and Book 8546, Page 26, Parcels 22 and 23 of the Los Angeles County Assessor's Records. Be, and the same hereby Is rezoned from R-l to R-l PD) in conformance with the General Plan, and the City Planner shall amend the Official Zoning Map' of the City of Baldwin Park to reflect such change. SECTION 2. That the City Council, at the time of the Public hearing relating to the zone change. Case Z-436, reviewed an application to develop a thirty-one 31) unit residential condominium project located on 4.09+^ acres at the herein described real property. SECTION 3. That the proposed project, attached hereto as Exhibit A" and incorporated herein by this reference, has been designed and reviewed in accordance with the provisions of Section 9800 et. seq. of the Baldwin Park Zoning Code. SECTION 4. That the City Council, at the time of the public hearing relating to the zone change. Case No. Z-436, certified the Negative Declaration of Environmental Impact. SECTION 5. That the City Council does hereby make the following findings of fact: 1. The proposed development Is consistent with the spirit and intent of the General Plan and Its elements; 2. The proposed development is not detrimental to surrounding properties; 3. The proposed project is a logical and rational development of the land; 4. That the proposed development is consistent with the spirit and intent of the Planned Development Overlay Ordinance. SECTION 6. That the City Council does hereby approve the project and adopt the following conditions: 1. That the property be developed as shown on Exhibit A" dated October 27, 1982; and 2. That the applicant shall provide to the City Planning Division, within thrity 30) days of the effective date of City Council adoption, revised site plans to Include: a. The location, type, and size of all on-slte exterior lighting. An additional three 3] to five 5) foot setback of a wall along Center Street and a five 5) or six 6) foot wall on the boundaries of the development. d. Proposed C.C.& Rs and to Include a restriction on parking in driveways adjacent to the public street. 3. That the applicant shall enter Into a density bonus development agreement with the City or remove one 1) dwelling unit from Parcel #2. 4. That the applicant shall dedicate and improve the eastern twenty-five 25) feet of Parcel #1 for the construction of Monterey Avenue and shall dedicate and improve Center Street as required by the City. 5. That a Tract Map be submitted as required by the City Engineer. 6. That the applicant shall commence construction within one 1) year of the effective date of CTty Council adoption. 7. That the applicant shall sign a notarized affidavit within fifteen 15) days after the adoption of this resolution stating he has read and accepts all conditions of approval. SECTION 7. That an agreement be executed as provided by Section 65915 of the Government Code containing the following provisions: 1. That a total of one 1) additional dwelling unit be permitted above and beyond the zoning code maximum as a density bonus. 2. That not less than twenty-five C25] percent of the total proposed project dwelling units be set aside by appropriate covenants, conditions and restrictions for sale to persons of low or moderate income. 3. That the plan, as approved by the City Council, be constructed and maintained subject to modifications as permitted by the Zoning Code. SECTION 8. That the City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner prescribed by law.
