AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK DISESTABLISHING
PARKING AND BUSINESS IMPROVEMENT AREA
NO. 1 URGENCY)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS
FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin Park
does hereby find, determine, and declare, as follows:
a) That pursuant to the provisions of Section
36500 et seq., of the Streets and Highways Code of the
State of California, the City Council did, on
November 17, 1982, adopt Ordinance No. 842 which estab-
lished a Citywide Business Improvement Area to be
effective on January 1, 1983; and
b) That said Citywide Business Improvement Area
includes within its boundaries all property within
Parking and Business Improvement Area No. 1, which was
established by Ordinance No. 802 adopted on October 17,
1979; and
c) That it was the intention of the City Council
that upon establishment of the Citywide Business Improvement
Area, said Parking and Business Improvement Area No. 1 would
be disestablished; and
d) That based upon the above determinations, the City
Council adopted on December 1, 1982, that certain Resolution
No. 82-89 entitled A Resolution of the City of Baldwin Park
Declaring its Intention to Disestablish Parking and Business
Improvement Area No. 1" and caused said Resolution to be
duly published and mailed as provided by law; and
e) That a public hearing concerning the disestablish-
ment of said Parking and Business Improvement Area No. 1
hereinafter Area No. I") was held on December 15, 1982, at
the hour of 7:00 p.m. in the City Council Chambers of the
City Hall of the City of Baldwin Park; and
f) That at said hearing all written and oral protests
made or filed were duly heard, evidence for and against the
proposed action was received and a full, fair and conplete
hearing was granted and held; and
g) That the public interest, convenience and
necessity require the disestablishment of Area No. 1.
SECTION 2. That pursuant to Section 36500 et seq., of the
Streets and Highways Code of the State of California, the Business
Improvement Area, created by Ordinance No. 802 and designated as Parking
and Business Inprovement Area No. 1 of the City of Baldwin Park,
and hereby is, disestablished, effective January 1, 1983.
SECTION 3. That upon disestablishment of Area No. 1, any
unexpended funds remaining in the Parking and Business Improvement
Area No. 1 Fund" as of January 1, 1983, shall be transferred to the
Citywide Business Improvement Area Fund" and shall be used only for
the purposes specified in Ordinance No, 842. Any unexpended funds frcm
Area No. 1 in the possession of the Chamber of Ccmrnerce on January 1,
1983, shall be transferred to the Citywide Business Improvonent Area
Fund" and shall be used only for the purposes specified in Ordinance
No. 842.

SECTION 4. That this Ordinance is hereby declared to be an
urgency insasure. The said Ordinance shall take effect inroediately upon
its adoption. A statement of facts constituting its urgency is as follows:
if Business Improvement Area No. 1 is not terminated on or before January 1
1983, the owners of businesses located in said Area, will be required to
pay duplicative assessments for business pro-notion purposes.
SECTION 5. That Ordinance No. 802 is hereby repealed and
rescinded-
SECTION 6. That the City Clerk shall certify to the adoption of
this Ordinance and cause the same to be published in the manner prescribed
by law.

hereby certify that the foregoing Ordinance No 8 50 was duly approved
and adopted by the City Council, of the City of Baldwin Park, as an
Urgency Ordinance at a regular meeting of the City Council on the 15th
day of December / 1982, by the following vote.
