AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK AMENDING CERTAIN
PROVISIONS OF THE BALDWIN PARK MUNICIPAL
CODE RELATING TO SUBDIVISIONS
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS
FOLLOWS:
SECTION 1. That subsections 8013 b) 4, 8013 e) and 8013 f)
of the Baldwin Park Municipal Code are amended to read as follows:
b) 4. Upon accepting the tentative map application
and required submissions, the Director immediately shall for-
ward copies of such documents to all affected Agencies and
City Divisions, including the City Planner and the City
Engineer, for review and comment. A notice of the proposed
subdivision shall be posted on and offsite within a radius
of 300 feet from the external boundary of the proposed project
as well as published in a newspaper of general circulation within
the City."
e) Appeal to Appeal Board. Any interested party
dissatisfied with a decision by the Advisory Agency, with
respect to a tentative map, may appeal to the Appeal Board.
Any such appeal shall be filed with the Secretary of the
Planning Commission within 15 days after the action of the
Advisory Agency. Upon filing of an appeal, a public hearing
before the Appeal Board shall be expeditiously held in the
form and manner required by the Subdivision Map Act. Notice
of the public hearing shall be given in the form and manner
required by Sections 66451.3 and 66451.4 of the Subdivision
Map Act. Within 15 days following the conclusion of the hearing,
the Appeal Board shall render its decision of the appeal."
f) Appeal to City Council. The subdivider or
Advisory Agency may appeal from the action of the Appeal Board.
Any such appeal shall be filed with the City Clerk within
15 days after the action of the Appeal Board. Upon the filing
of an appeal, a public hearing before the City Council shall
be expeditiously held in the form and manner required by the
Subdivision Map Act. Notice of the public hearing shall be
given in the form and manner required by Section 66451.3 and
66451.4 of the Subdivision Map Act. Within 15 days following
the conclusion of the hearing, the City Council shall render
its decision on the appeal."
SECTION 2. That the City Clerk shall certify to the adoption of
this Ordinance and cause the same to be published in the manner prescribed
by law.
