HomeMy WebLinkAboutORD 855ORD 855ÜÂh£ŸjìÓNORDINANCE NO. 855 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALDWIN PARK MUNICIPAL CODE CASE NO. AZC-87) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a. That on the 23rd day of February, the Planning Commission held a duly noticed public hearing on the application for an amendment to the Baldwin Park Zoning Code. b. The changes provide for the protection of the health, safety and welfare of the residents of Baldwin Park. c. The changes are not detrimental to properties in the City. d. The changes are consistent with the spirit and intent of the General Plan. SECTION 2. That Section 9363 of the Baldwin Park Municipal Code is amended by adding thereto subsection 11 the following: 11. The nonconforming use of a Game Arcade or Game Machine; two 2) years." SECTION 3. That Section 9450 et al. is hereby added to read as follows chapter 4 General Provisions and Standards Part N Game Machine and Game Arcade Regulations 9450. Purpose The purpose of the provisions contained within this Part is to establish a comprehensive set of regulations applicable to the placement and location of game machines and game arcades and to insure compatibility with surrounding properties. 9451. Game Machines Permitted. Game Machines not to exceed three C3) such machines, shall be permitted as an accessory use within any C" zone provided all other licenses and permits required by this code are obtained. 9452. Game Arcades Permitted. Game Arcades shall be permitted as a principal use in the C-l, C-2 and CM zones, provided that a conditional use permit, pursuant to Section 9300 et seq. hereof, is first obtained and all other licenses and permits required by this code are obtained. 9453. Development Standards. The development standards as set- forth in Section 9600 et seq. shall apply except as this Section specifically otherwise provides. All such development standards shall be observed at all times in the placement of any game machine or game arcade in the City. A. Location. Neither a Game Machine, nor a Game Arcade shall be located within five hundred 500) feet of a lot for which an educational institution is located» which conducts classes between the first and twelfth grades; B. Minimum Floor Area. Each Game Arcade shall provide a minimum of seven hundred and fifty 750) square feet of floor area for the operation of said game arcade; C. Minimum Aisle Width. Game Machines located along one side of an aisle shall maintain a minimum unobstructed aisle width of five 5) feet. Interior Visability. Each Game Arcade shall provide and maintain unobstructed interior visability from the outside of the building through windows or glass doors. All entrances, exits and interior areas shall be adequately lighted; Restrooms. Each Game Arcade shall provide and maintain a minimum of two public restroom facilities accessible to customers and employees; E. Bicycle Racks. The owner and/or operator of a game machine or a game arcade shall provide and maintain bicycle racks in a location and in an amount as determined to be sufficient by the officer or board granting the conditional use permit, as a condition of approval. F. 9454. Maintenance of Use. Each Game Arcade or establishment shall comply with the following requirements. Supervision. Each game arcade operator shall maintain on the premises, at all times, adult attendants, the number of which shall be set by the officer or hearing body as a condition of approval with respect of the conditional use permit; Hours of Operation. Each game arcade or establishment with a game machine shall prohibit persons under the age of seventeen 17) years from using any game machine between the hours of 8:00 A.M. and 3:00 P.M., Monday through Friday. This restriction shall not apply during school holidays and school vacations recognized by public schools within the City; B. C. Interior Signage. Signage informing the public of the prohibition on the use of drugs, smoking, loud conduct, and the hours of operation shall be posted and plainly visable to customers within the establishment in at least two C2) locations. SECTION 4. That the City Clerk shall ceTtify^^he adoption hereof, and cause the same to be published in the mannei/pro^cribed by law. That, thereafter, said Ordinance was duly approved and adopted at a regular meeting of the City Council on the 6th day of April 1983 by the following votes: COUNCILMEN King, McNeill, Aguilar.
