HomeMy WebLinkAboutORD 857ORD 857ÜÂh£ŸjìÓVORDINANCE NO. 857 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALDWIN PARK MUNICIPAL CODE RELATING TO THE R-l SINGLE FAMILY RESIDENTIAL ZONE REGULATIONS CASE NO. AZC-88) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That on July 1, 1983,Section 65852.1, as amended and Section 65852.2 of the Government Code, enacted by Chapter 1440 of the laws of 1982, will become effective; and b) That said sections require cities to permit the placement of second dwelling units on single family lots, and c) That the State law allows cities to designate areas for second units based on the adequacy of public services and facilities and to impose development standards upon such units; and d) That the public interest, convenience, and necessity require the establishing of zoning regulations relating to such second dwelling units, which must be made effective on or before July 1, 1983; and e) That the proposed changes provide additional means of safe, decent, and affordable housing; and Cf) That the proposed changes are not detrimental to properties in the City; and Cg) That the proposed changes are not contrary to the spirit and intent of the General Plan. SECTION 2. That Section 9100 of the Baldwin Park Zoning Code is hereby amended by the addition of the following definition: Section 9100. Definitions. S.10 Second Dwelling Unit shall mean an attached or detached dwelling unit which provides complete, independent living facilities for one or more persons; it shall include permanent provisions for living, sleeping, eating, and sanitation on the same parcel as an existing unit is situated.'* SECTION 3. That Section 9402 of the Baldwin Park Zoning Code is hereby amended by the addition of the following: Section 9402. Parking Spaces. A. Residential Zones. 1. R-l 2 parking spaces for each dwelling unit, which shall be located in a garage. That Section 9511 of the Baldwin Park Zoning Code is hereby amended by the addition of the following: Section 9511. Uses Permitted. A.3 A maximum of one 1) second dwelling unit per lot provided: a. The lot contains not less than 10,000 square feet of lot area; and b. The lot currently contains one 1) dwelling unit." SECTION 5. That Section 9513 of the Baldwin Park Zoning Code is hereby amended by the addition of the following: Section 9513. Development Standards. C.5 A detached second dwelling unit shall maintain a distance of not less than twenty 20) feet from the existing dwelling unit. L. Architecture. Each second dwelling unit shall be architecturally compatible with the existing dwelling unit." SECTION 6. That the City Clerk shall certify to the adoption hereof, and cause the same to be published in the/mainer prescribed by law. Passed and adopted this 1st day of/^une 1983.
