AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK AMENDING
THE MUNICIPAL CODE RELATING TO SALES
OF MERCHANDISE IN PUBLIC STREETS
URGENCY)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS
FOLLWS:
SECTION 1. That Chapter 12.05, entitled Street Vendors
Prohibited", consisting of Section 12.05.010 is hereby added to Title 12
of the Baldwin Park Municipal Code to read as follows:
Chapter 12.05, Street Vendors Prohibited"
Section 12.05.010. Sales of Goods, Wares and
Merchandise in Public Street Areas. No person shall
sell, engage in sales, or offer to sell, any goods,
wares or merchandise in any public street or public
parkway within the City of Baldwin Park,
As used herein public street" and public parkway"
shall be defined as follows:
a) public street" shall mean that portion
of a public street designated as such, which is
improved, designed and ordinarily used by the public
for the primary purpose of vehicular travel; and
b) public parkway" shall mean any portion of
a public street right-of-way, which is set apart by
curbs, barriers or markings or other delineation for
pedestrian travel."
SECTION 2. That Section 10.36.120 of the Baldwin Park Municipal
Code is hereby repealed and rescinded.
SECTION 3. That this Ordinance is hereby declared to be an
urgency measure, and shall take effect umediately upon its adoption. A
statement of facts constituting its urgency is as follows: That Ordinance
No. 859 was heretofore adopted, and is in full force and effect; that
subsequent to its adoption, the City reenacted its entire Municipal Code;
that it is necessary to place this Section in the new Municipal Code, as
reenacted. That the public interest, convenience and necessity require
the umiediate adoption of this Ordinance.
SECTION 4. That Ordinance No. 859 is hereby repealed and
rescinded.
SECTION 5. That the City Clerk shall certify to the adoption
of this Ordinance and cause the same to be published in the manner
prescribed by law.
