HomeMy WebLinkAboutORD 865ORD 865ÜÂh£Ÿjìâõ ORDINANCE NO. 865 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE ZONING OF SAID CITY, AND REZONING CERTAIN HEREIN DESCRIBED REAL PROPERTY, AND APPROVING DEVELOPMENT OF A SIX 6) UNIT RESIDENTIAL CONDOMINIUM PROJECT. CASE NO. Z-439 THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That notwithstanding the provisions of Section 17.54.010 of the Baldwin Park Municipal Code, that certain real property located in the City of Baldwin Park, County of Los Angeles, State of California, more particularly described as 13524 Los Angeles Street, Map Book 8546, Page 24, Parcel 26 of the Los Angeles County Assessor's Records) be, and the same hereby is rezoned from R-l to R-l PD) in conformance with the General Plan, and the City Planner shall amend the Official Zoning Map" of the City of Baldwin Park to reflect such change. SECTION 2. That the City Council, at the time of the public hearing relating to the zone change. Case Z-439, reviewed an application to develop a six 6) unit residential condominium project located on 62± acres at the herein described real property. SECTION 3. That the proposed project has been designed and reviewed in accordance with the provisions of Section 17.30 et. seq. of the Baldwin Park Zoning Code. SECTION 4. That the City Council, at the time of the public hearing relating to the zone change. Case No. Z-439, certified the Negative Declaration of Environmental Impact. SECTION 5. That the City Council does hereby make the following findings of fact: a. The proposed zone change is not contrary to the spirit and intent of the General Plan or its elements. b. The properties involved in the proposed zoning are more suitable for the purposes permitted in the proposed zone than for the purposes permitted in the present zone. c. The use permitted by the proposed zone is not detrimental to surrounding properties. d. That the proposed zone change is a logical and rational classification of the land. e. That the proposed development is consistent with the spirit and intent of the Planned Development Overlay Ordinance. SECTION 6. That the City Council does hereby approve the project and adopt the following conditions: a. That the property be developed as shown on Exhibit A" dated September 28, 1983. b. That the applicants shall enter into a density bonus agreement with the City, or develop only five 5) units. c. That a Tract Map and CC&Rs shall be submitted as required by the City for review and approval. That the applicants shall commence construction within one 1) year of the effective date of City Council adoption. e. That the applicants shall sign a notarized affidavit within fifteen 15) days after the adoption of this ordinance stating that they have read and accept all conditions of approval. SECTION 7. That an agreement be executed as provided by Section 65915 of the Government Code containing the following provisions: a. That a total of one 1) additional dwelling unit be permitted above and beyond the zoning code maximum as a density bonus. b. That no less than twenty-five 25) percent of the total proposed project dwelling units be set aside by appropriate covenants, conditions and restrictions for sale to persons of low or moderate income. c. That the plan, as approved by the City Council, be constructed and maintained subject to modifications as permitted by the Zoning Code. SECTION 8. That the City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner prescribed by law. APPROVED AND ADOPTED this 7th/d^y of December 1983.
