HomeMy WebLinkAboutORD 866ORD 866ÜÂh£ŸjìâñORDINANCE NO 866 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE ZONING OF SAID CITY, AND REZONING CERTAIN HEREIN DESCRIBED REAL PROPERTY IN CONFORMANCE WITH THE GENERAL PLAN. ZONE CHANGE CASE NO. Z-440 THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That notwithstanding the provisions of Section 17.54.010 of the Baldwin Park Municipal Code, that certain real property located in the City of Baldwin Park, County of Los Angeles, State of California, more particularly described as property located at 3221-3237 Vineland Avenue Book 8555, Page 13, Parcels 1, 2, 5, 6, and 7 of the County Assessor's Records) be, and the same hereby is rezoned from R-l to R-G PD) in conformance with the General Plan, and the City Planner shall amend the Official Zoning Map" of the City of Baldwin Park to reflect such change. SECTION 2. That the City Council, at the time of the public hearing relating to the zone change. Case Z-440, reviewed an application to develop an eighty 80) unit residential condominium project located on 5.34± acres at the herein described real property. SECTION 3. That the proposed project has been designed and reviewed in accordance with the provisions of Section 17.30 et. seq. of the Baldwin Park Zoning Code. SECTION 4. That the City Council, at the time of the public hearing relating to the zone change,determined that no further environ- mental review of the project was necessary pursuant to Section 15067 of CEQA. SECTION 5. That the City Council does hereby find as follows: a) That the proposed zone change is consistent with the spirit and intent of the General Plan and its elements. b) That the properties involved in the proposed zoning are more suitable for the purposes permitted in the proposed zone than for the purposes permitted in the present zone. c) That the proposed development is not detrimental to surrounding properties. d) That the proposed zone change is a logical and rational classification of the land. e) That the proposed development is consistent with the spirit and intent of the Planned Development Ordinance. SECTION 6. That the City Council does hereby adopt the following conditions a) That the subject property shall be developed substantially as shown on Exhibit A", dated September 28, 1983; and b) That the applicant shall work with Staff to develop solutions for improving the aesthetic appearance of the 600' northern driveway and the 6' masonry wall facing Vineland Avenue; and c) That the applicant shall submit a subdivision map and proposed covenants, codes, and restrictions to the City for review and approval; and BIB] 37971-U01 ORD-U02 866-U02 LI2-U03 FO4404-U03 FO32727-U03 DO33647-U03 C5-U03 ORDINANCES-U03 12/16/2003-U04 ROBIN-U04 ORD 866ÜÂh£ŸjìâñOrdinance No. g66 P^ 2 of 2 d) That the applicant shall submit to the Planning Division, within thirty 30) days of the effective date of the City Council adoption, revised plans to indicate the location of all exterior lighting and mailboxes, the locations of trash enclosures or an agreement with the refuse company for individual on-site pick up, the design changes required in condition b, the locations of textured paving, a zero-lot line for the dwelling units, the removal of the wood siding from Elevation A", the reversing of some of the dwelling units to provide greater diversity, and the wiring of the development for cable television; and e) That construction shall commence within one 1) year of the effective date of City Council adoption, and the perimeter wall being the first to be constructed; and f) That the applicant shall sign a notarized affidavit within fifteen 15) days after the adoption of the ordinance that the applicant has read and accepts all the conditions of approval. SECTION 7. That the City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner prescribed by law.
