AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK AMENDING
THE MUNICIPAL CODE RELATING TO
ALCOHOLIC BEVERAGE CONTAINERS
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS
FOLLOWS:
SECTION 1. That Chapter 9.09, entitled Possession of Opened
Alcoholic Beverage Containers", consisting of Section 9.09.010 and
9.09.020, is hereby added to Title 9 of the Baldwin Park Municipal Code
to read as follows:
Chapter 9.09, Possession of Opened Alcoholic Beverage
Containers Prohibited"
Section 9.09.010 Alcoholic Beverage Containers. No
person having in his or her possession any bottle, can, or
other receptacle containing any alcoholic beverage which
had been opened, and/or has had its seal broken, and/or as
to which the contents have been partially removed, shall
enter, be, or remain on the premises, including any
trnnediately adjacent parking area, of any retail package
off-sale alcoholic beverage licensee licensed pursuant to
Division 9 conmencing with Section 23000) of the Business
and Professions Code, or any public sidewalk imnsdiately
adjacent to the licensed and posted premises. The
provisions of this Section shall only apply to locations
where the signs are posted, pursuant to Section 9.09.020
hereof.
Section 9-09.020 Posting Signs. Every person owning
or operating a retail package off-sale alcoholic beverage
establishmsnt within the City licensed pursuant to
Division 9 ccamiencing with Section 23000) of the Business
and Professions Code, shall post and maintain in good
repair, in a conspicuous place at each entrance to the
licensed premises and to the parking lot immediately
adjacent thereto, a sign that gives notice substantially
as follows: Possession of Opened Alcoholic Beverage
Container on These Premises and the Adjacent Public Side-
walk is Prohibited. BPMC Section 9.09.010."
SECTION 2. That the Baldwin Park Municipal Code shall be amended
to make a violation of Section 9.09.010 punishable as an infraction.
SECTION! 3. That the City Clerk shall certify to the adoption of
this Ordinance and cause the same to be published in the manner prescribed
by law.

hereby certify that the foregoing Ordinance No. 872 was regularly introduced
and placed upon its first reading at a regular meeting of the City Council
on the 18th day of April/ 1984. That, thereafter, said Ordinance was duly
passed and approved at a regular meeting of the City Council on the 2nd
day of May, 1984, by the following vote:
