APPLICANT: DES ROCHERS, WRIGHT DEVELOP- MENT COMPANY CASE NO. Z-444 ASSOCIATED CASE AGP-66) LOCATION: GENERALLY LOCATED APPROXIMATELY 259^ FEET NORTH OF GARVEY AVENUE. AND APPROXIMATELY 117 FEET NORTH- WEST OF THE EAST PROPERTY LINE OF THE BIG DALTON WASH. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That an application for a change of zone from Zone OS, Open Space to Zone R-3. High Density Residential was submitted by the owners of real property and expanded by the City to include property located at approximately 259_^ feet north of Garvey Avenue, and approximately 117 feet north-west of the east property line of the Big Dalton Wash., described, more particularly as follows: A portion of lots 1, 2, 3, 4, 5, and 27 as shown on the map recorded in Book 22, Page 27 and a portion of lots 8, 9, 10, 11, 12 and 13 in Book 22, Page 26 of the Licensed Surveyor's Map in the office of the Los Angeles County Recorder, as shown on Exhibit C". b) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend the appproval of the reclassification to R-3, High Density Residential c) That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, and each member being familiar with the site, it was determined that the public interest, necessity, convenience, and general welfare require the change in zone classification, herein described. SECTION 2. That notwithstanding the provisions of Section 17.54 et. seq. of the Baldwin Park Municpal Code, the zoning classification of the Property is hereby reclassified from Zone OS, Open Space to Zone R-3, High Density Residential. SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law.
