HomeMy WebLinkAboutORD 876ORD 876ÜÂh£ŸjìâäORDINANCE NO. 876 AN ORDINANCE OF THE CITY OF BALDWIN PARK APPROVING AND ADOPTING THE AMENDED REDEVELOPMENT PLAN FOR THE WEST RAMONA BOULEVARD REDEVELOPMENT PROJECT WHEREAS, the Baldwin Park Redevelopment Agency, here- inafter referred to as the Agency", has formulated and prepared a proposed Amended Redevelopment Plan for the West Ramona Boulevard Redevelopment Project, hereinafter referred to as the Amended Redevelopment Plan"; and WHEREAS, because the changes made in the Amended Redevelopment Plan will not affect the City* s General Plan, the Agency was not required to submit this amendment to the Planning Commi s s ion; and WHEREAS, the Agency submitted to the City Council of the City of Baldwin Park, hereinafter referred to as the City Council", said proposed Amended Redevelopment Plan; and WHEREAS, the Agency has submitted the Report to City Council accompanying the Amended Redevelopment Plan to the City Council; and WHEREAS, after due notice, a Joint Public Hearing has been held by the Agency and the City Council; and WHEREAS, all actions required by law have been taken by all appropriate public agencies; and WHEREAS, after said joint public hearing, the Agency approved said Amended Redevelopment Plan and recommended adoption of said Amended Redevelopment Plan to the City Council. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. The purposes and intent of the City Council with respect to the Project Area are: 1. Eliminate the conditions of blight existing in the Project Area; 2. Insure, as far as possible, that the causes of blighting conditions in the Project Area will be either eliminated or protected against; 3. Encourage construction of new developments in the Project Area; 4. Encourage construction of quality, multi-family residential units to provide additional affordable housing in the City; 5. Redevelop, rebuild, and/or construct public facilities in the Project Area to provide safe and more efficient public services; and 6. Provide the City of Baldwin Park with assistance in implementing the previously adopted and amended Baldwin Park General Plan. The Amended Redevelopment Plan for the West Ramona Boulevard Redevelopment Project, referred to herein as the Amended Redevelopment Plan", is hereby approved, adopted and designated as the official Amended Redevelopment Plan for the West Ramona Boulevard Redevelopment Project Area, and is incorporated herein by reference. SECTION 3. The City Council hereby finds and determines that: 1. The Amended Redevelopment Plan will redevelop the Project Area in conformity with the California Health and Safety Code, Section 33000 et seq. in the interests of the public peace, health, safety and welfare; and 2. The adoption and carrying out of the Amended Redevelopment Plan is economically sound and feasible; and 3. The Amended Redevelopment Plan conforms to the General Plan of the City of Baldwin Park, as amended; and 4. The carrying out of the Amended Redevelopment Plan will promote the public peace, health, safety, and welfare of the City of Baldwin Park and will effectuate the purposes and policies of the California Health and Safety Code, Section 33000 et seq.; and 5. The condemnation of real property, as provided for in the Amended Redevelopment Plan, is necessary to the execution of the Amended Redevelopment Plan and adequate provisions have been made for payment for property to be acquired, as required by law; and 6• The elimination of blight and the redevelopment of the Project Area cannot be reasonably expected to be accomplished by private enterprise acting alone without the aid and assistance of the Agency. SECTION 4. The Amended Redevelopment Plan for the West Ramona Boulevard Redevelopment Project Area provides for the expenditure of money by the City in carrying out the Amended Redevelopment Plan, and authorizes the City to financially assist the Agency by way of loans, grants, or other financial assistance. The City Council hereby provides that such financial assistance to the Agency shall be made from time to time as the City Council shall determine to be necessary, and that all such financial assistance shall be deemed to be loans to the Agency based on terms to be established by an agreement between the City and Agency, unless the City Council shall provide in specific cases that such assistance shall be treated other than as a loan. SECTION 5. All written and oral objections to the Amended Redevelopment Plan are hereby overruled. SECTION 6. The City Clerk is hereby directed to send a certified copy of this Ordinance to the Agency, and the Agency is hereby vested with the responsibility for carrying out the Amended Redevelopment Plan. The City Clerk shall certify to the adoption of the Ordinance and cause the same to be published once in the newspaper of general circulation.
