HomeMy WebLinkAboutORD 891ORD 891pT3(ÌìâBORDINANCE NO. 891 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING CERTAIN ZONING REGULATIONS RELATING TO PLANNED DEVELOPMENT DISTRICTS CASE NO: AZC-92) The City Council of the City of Baldwin Park does ordain as follows:l SECTION 1. That Sections 17.30.030 through and including 17.30.070 of the Baldwin Park Municipal Code, are hereby amended to read as follows: 17.30.030. Effect of Creation of Planned Development Districts'.No building permit shall be issued for the construction, reconstruction or relocation of any building or structure, nor shall any use of land be ccmmenced or permitted on any lot within the City which is classified in a planned development district hereafter referred to as PD zone") unless a development plan therefore hereafter referred to as plan") has been approved, in the time and manner set forth herein. Where such a plan has been so approved, notwithstanding any other of the provisions of this title to the contrary, the conditions of approval imposed upon such plan, and the provisions of this chapter, shall be observed in development of the property to which such plan applies, to the exclusion of any contrary regulations applicable to such property by reason of the application of this title." 17.30.040. Uses Permitted. No person shall use any lot classified in the PD zone for any other use than those uses allowed by the underlying zone classification in which the lot is classified." 17.30,050. Applications for Approval of DevelopTient Plans. An application for approval of a plan shall be filed with the Secretary of the Planning Cornnission, including all of the following: A- the number of the lots involved, if more than one, the lot dimensions and total area? and B. the location, proposed use, size, height, floor plans, elevations of all proposed and existing buildings on the subject lot or lots, type and color of materials to be used on building exterior; and C. the locations, height and type of walls and fences; and D. the location and dimension of public and private streets, accessways, pedestrian walkways and loading areas; and E. a vicinity map locating the subject site relative to street intersections in the general vicinity; and F. the location, height, and design of outdoor lighting fixtures; and G. a schematic plan for the land- scaping of the development, including the location, size and type of planting, and a statement setting forth the method by which such landscaping shall be maintained after installation; and BIB] 37971-U01 ORD-U02 891-U02 LI2-U03 FO4404-U03 FO33427-U03 DO33622-U03 C5-U03 ORDINANCES-U03 12/16/2003-U04 ROBIN-U04 ORD 891pT3(ÌìâBH. proposed convenants, conditions and restrictions; and I. a phasing plan, if applicable; and J. such other information as may be deemed necessary by the director; and K. all such applications shall be prepared by a design team consisting of a registered building designer or an architect, and a registered civil engineer or a land surveyor; additional qualified persons may be included in a design team." 17.30.060. Minimum Areas for Develop-nent Notwith- standing any other provision of this chapter, no property shall be classified in the PD zone unless the area thereof meets the following requirements: A. R-l zone property: Not less than one 1) acre; and B. Properties classified in any other zone: Not less than Fifteen Thousand 15,000) square feet. 17.30.070. General Developnent Standards. The following development standards shall apply to each lot classified in a PD zone: A. Application of Zoning Regulations to PD zoned lots^ Except as hereafter expressly provided to the contrary, the development standards contained in the underlying zone classification applicable to lots included in a PD zone hereafter development standards") shall be observed notwith- standing the PD zone classification of such lots/ provided that such development standards relating to lot area, lot width, required yard areas, building height and building length, shall apply to lots classified in the PD zone, unless, as a part of the approval of a plan, specific conditions of approval are imposed upon such plan, relating to lot area, lot width, required yard areas, building height and building length. In the event that such conditions of approval increase or decrease the minimum require- ments relating to lot area, lot width, yards, building height or building length, the regulations established by such conditional approval shall control to the exclusion of any such development standards applicable by virtue of the underlying zone classification of the lot; and B. Open Space. Ccmmon and private open space shall be provided on all lots classified in a PD zone in accordance with the following: 1. Cannon Open Space; a) Each R-l zoned lot included in the PD zone shall have and maintain ccmmon open space as follows: i) Four hundred 400) square feet of cannon open space for each dwelling unit in a development having twenty 20) or less dwelling units; and ii) Three hundred 300) square feet of conmon open space for each dwell- ing unit in a development having at least twenty-one 21) but not more than forty 40) dwelling units; and 2- BIB] 37971-U01 ORD-U02 891-U02 LI2-U03 FO4404-U03 FO33427-U03 DO33622-U03 C5-U03 ORDINANCES-U03 12/16/2003-U04 ROBIN-U04 ORD 891pT3(ÌìâBiii) Two hundred 200) square feet of common open space for each dwelling unit in a developnent having forty-one 41) or more dwelling units; and iv) All required common open space shall have and maintain a minimum dimension of not less than thirty 30) feet. b) Each R-G and R-3 zoned lot shall have and maintain ccrrnon open space as required pursuant to chapters 17.12 and 17.14 of this title; and 2. Private Open Space: a) Each R-l zoned lot shall have and maintain private open space as follows: i) Not less than six hundred 600) square feet of private open space for each dwelling unit; and ii) All required private open space shall have and maintain a dimension of not less than fifteen 15) feet; and b) Each R-G and R-3 zoned lot shall have and maintain private open space as follows: i) Not less than two hundred 200) square feet of private open space for each dwelling unit; and ii) All required private open space shall have and maintain a dimension of not less than 10) feet; and C. Private Street Standards. Where private streets are authorized as a part of an approved plan, all such private street facilities shall be constructed in accordance with the City's then standard plans therefore; and D. Parking Requirements. Parking and load- ing requirements and off-street parking facilities shall be provided and maintained for each lot classified in the PD zone, as follows: 1. For R-l zoned properties: a) Each dwelling unit shall be permanently provided with a minimum of two 2) off- street parking spaces, fully enclosed in a garage having an automatic garage door opener. If such parking spaces are to be located in a building other than a garage designed for only two 2) vehicles, those parking spaces shall be designed and constructed to provide each dwelling unit with two 2) parking spaces, having security separations, including closeable doors, and shall provide a physical separation from adjacent parking spaces; and b) In addition to parking required in subsection E. 1) a) of this Section, one and one-half 1^) off-street parking spaces for guest parking shall be provided and maintained for each dwelling unit; and 2. R-G and R-3 developnents shall provide off-street parking in accordance with Section 17.34.220 hereof; and 3- BIB] 37971-U01 ORD-U02 891-U02 LI2-U03 FO4404-U03 FO33427-U03 DO33622-U03 C5-U03 ORDINANCES-U03 12/16/2003-U04 ROBIN-U04 ORD 891pT3(ÌìâB3. Conmercial or Industrial developments shall provide parking and loading spaces in the manner set forth in Section 17.34-010; and E- Density. The density of each residential PD developnent shall be established as a condition of approval on the plan, based upon the density permitted by the Zoning Regulations and/or the General Plan; areas permitted to be used for private streets or utility purposes of determining density; and F. Design Review Requirements. All uses, buildings or structures hereinafter proposed to be located on any property classified in a PD zone shall be subject to provisions of Section 17,52.010." SECTION 2. That Section 17.30.080 through 17.30.090 of the Baldwin Park Municipal Code be, and hereby are, repealed and rescinded. SECTION 3. That the City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner prescribed by law. PASSED AND APPROVED this 6th day of March.
