HomeMy WebLinkAboutORD 894ORD 894pT3(Ììâ”ORDINANCE NO. 894 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAIDWIN PARK APPROVING A ZONING CODE AMENDMENT CLARIFYING THE DEFINITION OF A HOTEL AND MOTEL. APPLICANT: CITY OF BAU3WIN PARK: CASE NO: AZC-93 THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find/ determine, and declare as follows: a) That a duly noticed public hearing was held upon said matter by the Planning Ccmnission, and based upon the evidence presented, it determined that the public necessity, con- venience, and general welfare required that it recoarrrend the approval of the Zoning Code amendment to Section 17.04.355 and 17.04.475 clarifying the definition of a hotel and Hotel; and b) That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, it was determined that the public interest, necessity, convenience, and general welfare required the approval of the Zoning Code amendment, herein described. SECTION 2. That Sections 17.02.110, 17.04.355 and 17.04.475 of Baldwin Park Municipal Code, are hereby amended to read as follows: 17.02.110 Use of Motels/Hotels. Notwithstanding any other provision of this Code to the contrary, no person shall permit the use or occupancy of any room or unit or ccmbination of such roans or units, in a hotel or motel, defined as such in this title, for a period in ex- cess of thirty 30) consecutive calendar days. 17.04.355 Hotel. Hotel" means any building or protion of any building with access provided through a corron entrance, lobby or hall- way, or one or more guestrooms, which have no cooking facilities and which are designed and intended to be used as temporary overnight accomsdations for transients. No person shall inhabit any rocms or units or combination of roans or units in the hotel facility for a period greater than thirty 30) consecutive days nor for less than a single full day. Facilities that permit greater periods of occupancy shall be deemed for all purposes, to be apartment houses, and shall cet the development standards for apartment houses. 17.04.475 Motel. Motel" means one or more buildings contain- ing guestrocms, without kitchen facilities, with each such guestroom having a separate entrance leading directly frcan the outside of the building or from an inner court or hallway; which facilities are designed for use for temporary overnight acccanodations primarily for autcrnobile tourists or transients. No person shall inhabit any rocm or unit or ccmbination of rooms or units of the facility for a period greater than thirty 30) consecutive days nor for less than single full day. Facilities that permit greater periods of occupancy shall be deoned for all purposes to be apartment houses and shall comply with the applicable standards of this code thereto. Motel" includes auto court, motor lodge and tourist court. One dwelling unit shall be per- mitted for use as a resident manager's unit. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and connents relating therto. That the City Council, based upon its public reviov, does hereby approve the pro- posed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Conmission. The Secretary of the Planning Ccannission shall file the Negative Declaration.
