HomeMy WebLinkAboutORD 901ORD 901pT3(ÌìâzORDINANCE NO. 901 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPTING CERTAIN REGULATIONS APPLICABLE TO SUBDIVISION SIGNS CASE NO. AZC-96 THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 17.32.040 of the Baldwin Park Municipal Code is hereby amended by modifying the provisions of subdivision C thereof and adding subdivision D thereto, to read, respectively, as follows: C. Temporary on-premise subdivision tract signs, provided: 1. No such sign shall have more than sixty-four 64) total or thirty-two 32) square feet per face of background sign area nor exceed a height of twenty 20) feet from finished grade, if freestanding; and 2. Such sign is utilized only in connection with the sale or lease of lots or dwelling units in the subdivision to which it relates; and 3. That any such sign shall be removed within thirty 30) days after the last lot in the subdivision to which it relates is sold for the first time, or a period of one 1) year after erection of such sign, whichever occurs first; and 4. Not more than one 1) such sign shall be permitted for each subdivision; and 5 That at the time of the approval of a tentative subdivision or parcel map, if the owner and/or developer desires to place such a sign, the owner and/or developer shall deposit the sum of five hundred dollars $500) with the City, or in an appropriate time deposit, to insure that upon the expiration of the time permitted for the removal of such sign, such sign shall, in fact, be so removed if the subdivider fails to remove such sign within such time, the funds so deposited shall be utilized by the City to enter upon the property upon which such sign is located, without notice to the owner and/or developer, to remove such sign, the cost of which shall be charged against the deposit; the balance of the deposit shall be refunded to the depositor; and 6, No person shall place or maintain, or permit the placement or maintenance of, a temporary on-premise subdivision tract sign, except in compliance with this subdivision, C; BIB] 37971-U01 ORD-U02 901-U02 LI2-U03 FO4404-U03 FO33427-U03 DO33612-U03 C5-U03 ORDINANCES-U03 12/16/2003-U04 ROBIN-U04 ORD 901pT3(Ììâz7. After a sign permit has been approved for such a sign no change in content or subdivision reference shall be made without the prior approval of the Director; and 8. For the purpose of this subdivision, C, a temporary on-premise subdivision tract sign' shall mean a sign located on property included within a tentative subdivision tract map or tentative parcel map, which exclusively advertises for sale or lease properties, with or without improvements thereon, located within the boundaries of the tentative subdivision tract map or tentative parcel map/- and D. Temporary off-premise subdivision tract signs, provided: 1 Temporary off-premise subdivision tract sign structures for such signs shall not be located closer than six hundred 600) feet from any other such sign structure; and 2. An application shall be submitted to the Director for approval for each such pro- posed sign structure; where such a sign structure is proposed to be located on private property, the application shall include the written consent therefor, of the owner of such property; the Director shall review such proposed location to insure, with reference to private property locations, that the same is compatible with surrounding and adjacent uses with respect to proposed locations in public rights-of-way, the Director shall review the same to insure that the placement will not cause visual clutter; nor any interference with any public use; nor cause any adverse effect in terms of traffic control and traffic flow; the Director shall deny an application if the requirements of this subsection, 2, or this subdivision, D, are not, or will not be, met; and 3. Such signs shall have a background sign face area not in excess of five-hundred and forty 540) square inches, and shall be sixty 60) inches in width and nine 9) inches in height; such signs shall be placed and maintained only upon a sign structure as is described on that certain diagram, incorporated herein by this reference, marked Temporary Off-Premise Subdivision Tract Signs * on file in the Office of the City Planner of the City; and 4. Not more than six 6) such signs shall be permitted for each subdivision or parcel map and 5. That at the time of the approval of any tentative subdivision or parcel map, if the owner and/or developer desires to place such signs, the owner and/or developer shall deposit the sum of five hundred dollars $500) with the City, or in an appropriate time deposit, to insure that upon the expiration of the time permitted for the removal of each such sign, that such signs shall, in fact, be so removed; if the subdivider fails to remove such signs within such time, the funds so deposited shall be utilized for the City to enter upon the property upon which the signs are located, without notice to the owner and/or developer, to remove such signs, the cost of which shall be charged against the deposit and the balance of the deposit shall be refunded to the depositor; and 7. That the Director shall not issue a permit for any such sign unless and until all nonconforming subdivision directional signs associated with the subdivision or parcel map in question are removed; and 8. That any such sign shall be removed within thirty 30) days after the last lot in the tract to which it relates is sold for the first time, or a period of one 1) year after erection of such sign, whichever occures first/- and 9 Sign structures shall be located on properties which are near or adjacent to a secondary or major highway; and 10. No person shall place or mantain, or permit the placement or maintenance of, a temporary off-premise subdivision tract sign, except in compliance with this subdivision, D; and 11. For the purpose of this subdivision D, a temporary off-premise subdivision tract sign" shall mpan signs which contain one name of a subdivision and a directional arrow relating therto. SECTION 2. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 3.
