HomeMy WebLinkAboutORD 902ORD 902pT3(ÌìâfORDINANCE NO- 902 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALDWIN PARK ZONING CODE RELATING TO R-G AND R-3 ZONE REGULATIONS THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOW: SECTION 1. That Chapters 17.12 and 17.14 of Title 17 of the Baldwin Park Zoning Code, are hereby repealed and rescinded. SECTION 2. That Chapter 17.12 is hereby added to Title 17 of the Baldwin Park Zoning Code, consisting of Sections 17.12.010 through 17.12.100 inclusive, to read as follws: CHAPTER 17.12 R-G AND R-3 RESIDENTIAL ZONES 17.12.010 Purpose. In order to provide for the development of residential garden and high density multiple- family residential areas and to maintain the integrity of existing residential garden and high density multiple-family residential areas within the city, the regulations set out in this chapter shall be applicable to all properties classified in the R-G and R-3 zone. 17.12.015. Definitions. In addition to the definitions contained in Chapter 17,04, for the purpose of this chapter, the following words or phrases shall be defined as follows, unless it is apparent frca-n the context that another meaning is intended: A. Building setback, required' means a horizontal distance, determined in the manner set forth in this chapter, separating a building wall from a property line or another building; and B. Building wall length' means an exterior building wall not less than ten 10) feet in length measured in a horizontal plane as depicted on a plan view, having no perpendicular offset in excess of four 4) feet, in accordance with Diagram G, attached to the Ordinance codified in this title, on file in the office of the City Clerk. C. Inner court' means a cannon open space area enclosed by three 3) or nore exterior building walls located upon the same lot, which shall not have a depth greater than one and one-half 1-1/2) times the width thereof, maintained in accordance with Diagram J attached to the Ordinance codified in this title and filed in the City Clerk's Office; and D. Open space, private' means that open space, which is immediately adjacent to the dwelling unit served therby, and which is available for the exclusive use of the occupants of such dwelling unit; and F. Tcwnhouse Unit' means a dwelling unit which shares a ccanmon interior wall with another dwelling unit and no portion of which is above or below another dwelling unit; and G, Wall, Primary' means an exterior building wall which has therein kitchen or living room windows or any entry doors leading directly into a dwelling unit unless any such door or doors leads to a bedroom or dining room from a private open space area; and H. Wall, Secondary' means any exterior building wall, other than a primary wall, which has windcws or doors located therein and any second and third story exterior building wall exclusive of a primary wall; and I. Wall, windovless' nieans a first story exterior building wall which has no windows or doors located therein 17.12.020 Uses permitted. No person shall use, nor shall any person permit the use of, any property classified in the R-G or R-3 zones, for any use other than the following: A. Principal Uses. 1. Multiple-Dwelling units; 2. Condominiums 3. Tcwnhouses 4. One-family units allowed pursuant to a Planned Development Zone B. Accessory Uses. Those uses expressly designated as accessory uses pursuant to the provisions of this Title. 17.12.030 Uses permitted by conditional use permit. Ihe following uses shall be permitted on an R-G or R-3 zoned lot, provided a conditional use permit therefor, is first obtained pursuant to this Title: A. Churches; provided the same is located upon a lot having a lot area of at least one-half 1/2) an acre; B. Educational institutions; provided the same is located upon a lot having a lot area of at least one-half 1/2) an acre; D. Nursing, convalescent or rest homes; provided the same is located upon a lot having a lot area of at least one-half 1/2) an acre; E. Hones for the physically or mentally in-paired; provided the same is located upon a lot having a lot area of at least one-half 1/2) an acre; F. Hospitals; provided the same is located upon a lot having a lot area of at least one-half 1/2) an acre; G. Mobilehcffne parks in accordance with Section 17.38.010; provided, that the maximum number of mobilehomes on a lot shall not exceed the maximum allowable density applicable to the lot, pursuant to the provisions of this Charter; H. Off-street parking in conjunction with ccarmercial and manufacturing uses; provided/ that a six-(6) foot masonry block wall shall be constructed on such lot adjacent to any R' zoned property. The wall shall be reduced to thirty- six 36) inches in height in and along any required front yard area. Such parking facilities shall observe a front yard area not less than fifteen 15) feet in depth, which shall be fully landscaped as predicted with Diagram E, attached to the ordinance codified in this title and filed in the City Clerk's Office; I. Private recreational facilities. 17.12.040 Density. A. R-G Zone. The density of dwelling units on any lot in the R-G zone shall not exceed 17.4 dwelling units per acre. B. R-3 Zone. The density of dwelling units on any lot in the R-3 zone shall not exceed 29.04 dwelling units per acre. Density pursuant to this section shall be determined by dividing the lot area of the lot upon which the units are proposed to be located, by 43,560, and multiplying the quotient by the applicable density figure. 17.12.050 Development standards. All uses on lots classified in the R-G or R-3 zones shall comply with the following standards: A. Minimum lot area. Maximum building height. No building or structure shall be permitted to exceed a height equal to three 3) stories or thirty-five 35) feet, whichever is lesser; C. Minijnum lot width. Each lot hereafter created shall have and maintain a lot width of not less than fifty 50) feet/ except that comer lots shall have and maintain a lot width of not less than fifty-five 55) feet; D. Maximum building length. No building shall be constructed in excess of one hundred twenty-five 125) feet in length; E. Required yard areas. Each lot shall have and maintain front, side, and rear yards in conformance with the following requirements: 1) Front Yards: A front yard having a depth of not less than fifteen 15) feet, except that when such a lot fronts or sides on any lot in the R-l zone, or which is separated from such R-l zone lot by a street, the depth of the required front yard shall be not less than twenty 20) feet; 2) Side Yards; i) Interior Lots. Side yards on interior lots shall observe a width of not less than five 5) feet; ii) Comer Lots. Side yards on comer lots shall observe a width of fifteen 15) feet on the street side; side yards on the non-street side shall observe a width of not less than five 5) feet; 3) Rear Yards. A rear yard having a depth of not less than five 5) feet. F. Building setbacks. All buildings and structures shall observe and maintain the required building setback areas as determined by the formulae and tables as set forth in Diagram H, attached to the ordinance codified in this title and filed in the City Clerk's Office; except, that when a lot shares a ccanmon side or rear lot line with an R-l zoned lot, the depth of the side or rear building setback shall not be less than twenty 20) feet; and in no event shall the minimum building setback be less than the required yard area. 4- BIB] 37971-U01 ORD-U02 902-U02 LI2-U03 FO4404-U03 FO33427-U03 DO33611-U03 C5-U03 ORDINANCES-U03 12/16/2003-U04 ROBIN-U04 ORD 902pT3(ÌìâfG. Private open space. Each dwelling unit shall have and maintain not less than one hundred 100) square feet of private open space, located so as to be directly accessible to the dwelling unit served thereby; such required open space may be divided into segments containing not less than fifty 50) square feet each, each segment shall observe a minimum dimension of five 5) feet; provided that buildings and structures permitted to be located in private open space shall observe a vertical clearance of not less than eight 8) feet and shall not cover more than fifty 50) percent of the required private open space. H. Cannon open space. Each lot shall have and maintain cannon open space in accordance with the following; 1) General. a) Coverage. Not more than forty 40) percent of any required cannon open space shall be covered by permitted buildings or structures including the second or third story of any building. b) Clearance. All cannon open space shall maintain vertical clearance of not less than eight 8) feet. The second and/or third story overhang of any building shall not intrude into any cannon open space area a distance of more than five 5) feet: 2) Linear Method, Each dwelling unit shall be provided with not less than two hundred 200) square feet of cannon open space which shall have a minimum dimension of five 5) feet/- provided that not less than one hundred 100) square feet of usable cannon open space per unit shall abut each unit- If the amount of cannon open space abutting a dwelling unit pursuant to this sub- division, is less than two hundred 200) square feet, the balance of the required cannon open space for that unit shall be provided imnediately adjacent to the building in which the unit is located, as illustrated on Diagram I, attached to the ordinance codified in this title and filed in the City Clerk's Office; 3) Inner Court Method. When cannon open space is provided for dwelling units, in an inner court, such open 5- BIB] 37971-U01 ORD-U02 902-U02 LI2-U03 FO4404-U03 FO33427-U03 DO33611-U03 C5-U03 ORDINANCES-U03 12/16/2003-U04 ROBIN-U04 ORD 902pT3(Ììâfspace may be reduced to 100 square feet per dwelling unit served if such open space: i) has a minijnum dimension of ten 10) feet; and ii) each dwelling unit served thereby has direct access thereto; and iii) such cannon open space is in a single contiguous area within such inner court, as illustrated on Diagram J, attached to the ordinance codified in this title and filed in the City Clerk's Office; or I. Fences and walls. Side and rear lot lines of each such lot shall have solid wood or masonry walls which shall be maintained in accordance with Section 17.46.010. J. Mimjnum floor area for dwelling units. levelling units shall have a minimum gross floor area, excluding garage areas, as follows: 1) Efficiency units, four hundred fifty 450) square feet; 2) One bedroon units, six hundred fifty 650) square feet; 3) Two bedrocm units, eight hundred fifty 850) square feet; 4) Three bedrocm units, one thousand fifty 1050) square feet; 5) For each additional bedroom in units having rore than three 3) bedrocms/ one hundred fifty 150) square feet of additional floor area. K. Interior dwelling unit standards. Attached to the ordinance codified in this chapter, and incorporated in this chapter by this reference, is that certain document entitled Diagram K Baldwin Park Municipal Code Interior Multifamily Dwelling Unit Standards', which contains certain charts and diagrams. All dwelling units located on an R-G or R-3 zoned lot shall be designed and maintained in accordance with the charts, diagrams and standards as set forth in Diagram K. L. Parking. Each lot created after December 17, 1983, shall have a minimum street frontage of fifty 50) feet. 17.12.070 Minimum distance between roofs or eaves. The minimum allowable distance between roofs or eaves of buildings located upon the same R-G or R-3 lot shall be ten 10) feet. 17.12.080 Landscaping. In addition to all other requirements for landscaping pursuant to the provisions of this Title, a strip of landscaping five 5) feet in width shall be installed and maintained inrnediately abutting each building located upon any R-G or R-3 lot; provided that the width of the landscaping strip may be reduced to three 3) feet along a wall which is adjacent to a required driveway, as illustrated in Diagram I, attached to the ordinance codified in this title and filed at the City Clerk's Office. 17.12.090 Uses permitted in required building setback areas. Only the following uses shall be permitted in a required building setback area: A. Building setback areas which abut a required front yard area may be used for any purpose for which open space may be utilized pursuant to this title; and B. Building setback areas which abut required side yard areas or required rear yard areas, may be utilized for any use permitted in a required side or rear yard area, or for any use permitted in a required open space area pursuant to this title; in addition open vehicular parking facilities and trash enclosures may be located in a required building setback area which separates a building from a rear lot line; and C. Building setback areas which are established so as to separate buildings, may be utilized for open vehicular parking and trash enclosures, and any purpose for which open space may be utilized. 17.12.100 Intrusions into yard areas and building setback areas. Intrusions into required yard areas and required building setback areas shall be permitted only as is set forth in Section 17.46.040 of the Code." SECTION 3. That Sections 17.46.010 through 17.46.060 of Chapter 17,46 of Title 17 of the Baldwin Park Zoning Code are hereby amended to read, respectively, as follows: CHAPTER 17.46 HEIGHTS, YARDS FENCES, WAULS AND SHRUBS 17.46.010 Generally. Penthouse or roof structures for the housing of elevators, stairways, tanks, ventilating fans or similar equipment required to operate and maintain the building, fire or parapet walls, skylights, flagpoles, chimneys, snokestacks, wireless masts and similar structures, may be erected in excess of the height limits prescribed by this chapter. 17.46.030 Yard regulations. Except as expressly provided in this chapter, every required yard area shall be open and unobstructed frcm the ground to the sky. No yard or open space provided around one building for the purpose of ccmplying with the yard and/or open space provisions of this chapter shall be considered as providing yard or open space for any other building, and no yard or open space on any one lot shall be considered as providing a yard or open space for a building on a different lot. 17.46.040 Permitted intrusions into required yard areas or required building setback areas. The following intrusions may project into any required yard areas and required building setback areas, but in no case shall such intrusions extend more than twenty-four 24) inches into such required yard areas, or required building setback areas, except as is expressly permitted in this section: A. Cornices, eaves, belt courses, sills, bay windows, buttresses or other similar architectural features; B. Fireplace structures not wider than eight 8) feet measured along the wall of which it is a part; C. Stairways, balconies and fire escapes; D. Planting boxes or masonry planters not exceeding thirty-six 36) inches in height; E. Guard railings; F. Outside storage structures attached to R- G and R-3 dwelling units not wider than six 6) feet, 17.46.050 Wall, fence or shrub may be maintained. A. On an interior lot, a wall, fence or shrub not more than six 6) feet in height may be located anywhere on such lot, except in required front yard areas or in required side yards on the street side of such lots. The provisions of this section shall not be deemed to prohibit fences expressly required by any law. In any R' zone, a solid wall, fence or shrub thirty-six 36) inches in height or a forty-eight 48) inches nonview obscuring fence, may be located and maintained in any required front or streetside required side yard area. B. Shrubs, flowers, plants and hedges not nore than thirty-six 36) inches in height, and trees shall be permitted in any required yard area, except as provided in Section 17.46.040." SECTION 4, That Ordinance No 878 is hereby repealed and rescinded: Not withstanding any other provision of this ordinance any person who as of the effective date of this ordinance has on file a bona fide application for a building permit for any use permitted in RG or R3 zone shall be permitted to construct the development as described in the building permit issued pursuant to such application in accordance with zoning regulations in effect prior to the effective date of this ordinance. SECTION 5. That the City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner prescribed by law. PASSED and APPOVED this 7th da^of August, 1985.
