AN ORDINANCE OF THE CITY OF BALDWIN PARK
AMENDING SECTIONS 17.56.100 AND 17.56.110 OF
THE BALDWIN PARK MUNICIPAL CODE RELATING TO
PROCEDURAL ZONING MATTERS
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES
ORDAIN AS FOLLOWS:
SECTION 1. That Section 17.56.100 of the Baldwin Park
Municipal Code is hereby amended to read as follows:
17.56.100 Effective date of order granting
or denying variance or conditional use permit.
The planning commission resolution acting upon zone
variance, minor variance, conditional use permit
application, or modification or revocation relating
thereto, shall become effective and final as set
forth in Section 17.56.110 hereof."
SECTION 2. That subdivision A of 17.56.110 of the
Baldwin Park Municipal Code is hereby amended to reas as
follows:
A. The resolution of the planning commission
acting upon a zone variance, a minor variance, a
conditional use permit, or a modification or
revocation relating thereto, shall become effective
and final on the twentieth 20) day following its
adoption, or upon the day following the first
regular city council meeting occurring after
adoption of such resolution, whichever shall occur
last, unless, within such period of time, an appeal
in writing is filed, appealing the decision of the
commission to the city council, with the city clerk
by the applicant or pennittee, or any other person
aggrieved by such decision who appeared at the
planning commission hearing. No such appeal shall
be accepted for filing, except upon payment of an
appeal fee in an amount as set by resolution of the
city council. Within the said period of time
above-described, the city council, by motion
carried by not less than three 3) affirmative
votes thereof, may appeal the decision of the
commission to itself. Such city council action
shall be deemed, for all purposes, an appeal of the
decision of the commission."
SECTION 3. That this Ordinance is hereby declared to
be an urgency measure and shall take effect immediately upon
its adoption. A statement of facts constituting the basis of
the urgency of this Ordinance is as follows:
a) That the time of recent adoption and
recodification of the City^s zoning regulations, a
provision which permitted the City Council to appeal the
decisions of the Commission relating to zone variances
and conditional use permits, to itself, was omitted by
inadvertence;

ORD 905 pT3 (Ìì â ^ b) That this emission has been called to the
attention of the City Council and unless the omission is
corrected by insertion of that express power in the City
Council, to appeal such decision, decisions of the
Planning Ccarmission which should be reviewed by the City
Council body will become final without such additional
administrative appeal review;
c) That the public interest, convenience and
necessity require the enactment of this Ordinance as an
urgency measure.
SECTION 4. That this Ordinance shall take effect
inmediately upon its adoption. That the City Clerk shall
certify the adoption hereof and cause this Ordinance to be
published in the manner prescribed by law.
