HomeMy WebLinkAboutORD 907ORD 907pT3(Ììâ?ORDINANCE NO. 907 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A ZONING CODE AMENDMENT TO SECTION 17.10.180 YARD AREAS FOR FLAG LOTS AND SECTION 17.34.030.6 PARKING STANDARDS FOR FLAG LOTS. APPLICANT: CITY OF BALDWIN PARK/- CASE NO.: AZC-98. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: Section 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend the approval of the Zoning Code amendment amending Sections 17.10.180, 17.34.030; and b) That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, it was determined that the public interest, necessity, convenience, and general welfare required the approval of the Zoning Code amendment, herein described. SECTION 2. That Sections 17.10.180 and 17.34.030 of the Baldwin Park Municipal Code, are hereby amended to read as follows: 17.10.180 Flag lots—Yard areas for flag lots. Each flag lot shall observe the following minimum required yard areas: A. Front yards, not less than fifteen 15) feet in depth as measured from the rear property line of the lot fronting onto a public street, or from the property line perpendi- cular to the public street adjacent to the access way as shown in Diagram B; and B. Side yards, not less than five 5) feet in depth; and C. Rear yards, not less than twenty 20) feet in depth. 17.34.030 General development standards. 6. Parking facilities for an R-l flag lot shall be located so that no automobile is required to back onto a public street. SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the pro- posed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment, SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The City Clerk shall file the Negative Declaration of Environmental Impact.
