HomeMy WebLinkAboutORD 916ORD 916ÜÂh£ŸjìãÈORDINANCE NO. 916 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A ZONING CODE AMENDMENT TO CHAPTER 17.48 APPLICANT: CITY OF BALDWIN PARK? CASE NO.; AZC-100). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Bald- win Park does hereby find, determine, and declare as follows: a. That on the 25th day of September, 1985, the Planning Commission held a duly noticed public hearing on the application for an amendment to to the Baldwin Park Zoning Code. b. The proposed change provides for the protection of the health, safety, and welfare of the re- sidents of Baldwin Park; and c. The proposed change is not detrimental to the properties within the City; and d. The proposed change is consistent with the spirit and intent of the General Plan. e. That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, it was determined that the public interest, necessity, convenience, and general welfare required the approval of the Zoning Code amendment, herein described. SECTION 2. That Sections 17.48.005, 17.48.040, and 17.48.050 of the Baldwin Park Municipal Code, are hereby amended to read as follows: 17.48.005 Definitions. For the purposes of this chap- ter, the phrases hereinafter set forth, shall be de- fined as follows: A. Satellite dish" means any parabolic antenna designed for receiving satellite transmissions, having a diameter greater than two 2) feet. B. Solar panel" means any solar collector or other solar device, or any structural design feature of a building whose primary purpose is to pro- vide for the collection, storage and distribu- tion of solar energy for space heating or cool- ing, for water heating or for electricity. 17.48.040 Satellite dishes. Satellite dishes/ as defined in this Chapter, shall be permitted, pro- vided, that the same conform to the following provisions: A. Building permits shall be required for all satellite dishes. All satellite dishes shall be supported on a stable supporting base approved by the Building Division. Satellite dishes shall not be attached to the walls or roofs of any building or structure. C. Satellite dishes shall not be permitted with- in a required front yard or side yard adjacent to the street or within the area between the building and the street side property line. D. All portions of a satellite dish must maintain a distance of at least five 5) feet from any property line. E. No satellite dish shall be higher than fifteen 15) feet above grade level. F. All ground mounted satellite dishes shall be screened from the street and adjacent properties by a six foot high solid fence or masonry wall. 17.48.050 Solar panels. Solar panels, as defined in this Chapter, shall be permitted, provided, that the same conform to the following provisions: A. Solar panels and related equipment mounted on roofs clearly visible from the street shall conform to the following: 1. The collectors shall be generally mounted parallel with the roof pitch; and 2. The distance between the roof and upper- most portion of the solar panel shall not exceed 18"; and 3. Roof penetration shall be used to conceal supply/return water lines and/or electrical wiring from public visibility B. Solar panels and related equipment mounted on roofs not clearly visible from the street shall conform to the following: 1. Solar panels shall be generally mounted parallel with the roof pitch. 2. The distance between the roof and upper- most portion of the collector s) shall not exceed 24"; and 3. Exposed supply/return water lines are permitted provided: a. The covering insulation is colored to match that of the abutting roof and wall surfaces; and b. Eave penetration is used for per- pendicular descent of water lines from the roof to exterior building wall surfaces. All mounting brackets and related structural supports extending more than 3" above the roof surface shall be covered in a manner architect- urally compatible with the building to screen from public visibility and/or abutting proper- ties. All solar equipment, except portions of the collectors that must be black or clear glass or plastic to allow light transmission, in- cluding mounting brackets and/or screening materials shall match the abutting surface color* No portion of any roof mounted solar equipment may extend above the ridge line or below the gutter line. Ground mounted panels shall be screened from the street and adjacent properties by a six foot high solid fence or masonry wall. The system must be certified by the State and appropriately labeled. All installations must be done in compliance with Building and Safety Code requirements and building permits obtained. SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration. That the City Council, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a signifi- cant effect on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The Secretary of the Planning Commission shall file the Negative Declara- tion of Environmental Impact.
