AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK AMENDING
TITLE 3, CHAPTER 3.32 OF THE BALDWIN
PARK MUNICIPAL CODE RELATING TO
UTILITY USERS TAX
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES
ORDAIN AS FOLLOWS:
SECTION 1. That Chapter 3.32, Section 3.32.070A is
hereby amended to read as follows:
A. Any service user shall be eligible for an
exemption from the taxes imposed by this Chapter if 1) he or
she is sixty-two 62) years of age or older; and/or 2) he or
she is certified as meeting the criteria of disability as
established by the Social Security Administration for
Supplemental Income for the Aged, Blind or Disabled; and/or
3) the annual gross income of all persons in the household in
which such individual resides is less than the annual amount
prescribed by Resolution of the City Council. The exemptions
permitted hereunder: 1) shall apply only to taxes imposed by
this Chapter on the residence in which the service user
resides; and 2) shall not apply to the taxes imposed on any
other property owned by the individual; and 3) shall not
apply to a second utility service account within the household
if such service is used for business purposes."
SECTION 2. That Chapter 3.32, Section 3.32.070P is
hereby added to read as follows:
P. Notwithstanding the provisions of Subsection E,
service users who otherwise qualify for an exemption from the
tax pursuant to Subsection A who reside in mobile home parks
may receive a refund of taxes paid pursuant to this Chapter
for services provided through a master meter by filing an ap-
plication with the Tax Administrator in such form and at such
times as are required by the Tax Administrator."
SECTION 3. That Chapter 3.32, Section 3.32.080C
shall be amended to read as follows:
Notwithstanding the provisions of Subsection A, the
tax imposed under this Section shall not be imposed upon any
person for using intrastate telephone communication services
to the extent that the amounts paid for such services are
exempt from or not subject to the tax imposed under Division
2, Part 20 of the California Revenue and Taxation Code or the
tax imposed under Section 4251 of the Internal Revenue Code."
SECTION 4. That the City Clerk shall certify to the
adoption of this Ordinance and cause the same to be published
in the manner prescribed by law.

day of February/ 1986. That, thereafter, said Ordinance was
duly approved and adopted at a regular meeting of the City
Council on the 5th day of March, 1986. by the following
