HomeMy WebLinkAboutORD 930ORD 930ÜÂh£ŸjìãkORDINANCE NO. 930 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALDWIN PARK ZONING REGULATIONS RELATING TO THE F-C ZONE. AZC-103) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS; SECTION 1. That Title 17 of the Baldwin Park Municipal Code is hereby amended by adding thereto Chapter 17.21, consisting of Sections 17.21.010 through 17.21.050, inclusive, to read as follows: CHAPTER 17.21 Freeway Commercial Zone. 17.21.010 Purpose. In order to provide and en- courage development of freeway oriented retail and/or office complexes, and to insure compatibility with adjacent land uses, the regulations set out in this chapter shall be applicable to all lots classified in the F-C zone. 17.021.020 Uses Permitted. No person shall use, nor shall any person permit the use of, any lot classified in the F-C zone, for any use other than: A. Principal Uses. Commercial. Any of the following uses: 1. Antiques, art stores and galleries; 2. Apparel shops; 3. Automobile supply stores; 4. Bakery and confectionery shops; 5. Barbershops or beauty parlors; 6. Book and stationery stores; 7. Bowling alleys; 8. Business and professional colleges; 9. Department stores; 10. Drugstores, pharmacies; 11. Dry cleaners; 12. Florist shops; 13. Furniture and appliance stores; 14. Gift shops; 15. Hardware stores; 16. Dance studios; 17. Hobby shops; 18. Grocery markets; 19. Jewelry stores; 2 0. Laundromats; 21. Pet stores; 22. Print shops; 23. Photography stores, studios; 24. Shoe stores; 25. Restaurants, cafes; 26. Tailor shops; 27. Any use as determined to be a permitted use by the Director, pursuant to Section 17.06.060. B. Principal Uses. Office Usage. Any complex containing business/ professional, medical and/or dental offices, or any combination thereof. Accessory Uses: Those uses designated as accessory uses pursuant to this Title. 17.21.030 Uses Permitted by Conditional Use Permit. The following uses shall be permitted on lots classified in Zone F-C subject to the issuance of a conditional use permit pursuant to Chapter 17.54 hereof: A. Alcoholic beverages, on-site and off-site sales; B. Ambulance service; C. Automobile service stations; D. Banks, financial institutions; E. Dance studios; F. Day care nurseries or nursery schools; G. Drive-up and drive-thru establishments; H. Game arcades; I. Health studios, gymnasiums, martial arts studios; J. Hotels and motels; K. Hospitals; L. Lodges and clubs; M. Mortuaries; N. New and used vehicles or boats, leasing, rental or sales; 0. Private recreational facilities; P. Private schools; Q. Theaters walk-in). 17.21.040 Development Standards. All uses on lots classified in the F-C zone shall comply with the regula- tions contained in Chapter 17.16. In addition, the following regulations shall apply to all such uses: A. Yards. Required front yards and side yards adjacent to streets shall have and maintain a depth of not less than 10) ten feet. Not more than 40% of any required front yard or side yard area adjacent to a street shall be used for vehicular driveways. B. Signage: The provisions of Chapter 17.32 hereof shall apply to all uses placed or to be placed on lots classified in the F-C zone except that no freestanding sign shall be permitted on any lot classified in zone FC. Each such lot may have one 1) monument sign per lot, provided that its total background face area shall not exceed one 1) sq, ft. for each lineal ft. of street frontage of the lot, or 100 sq. ft., whichever is lesser. The max- imum height of such monument sign shall not exceed nine 9) ft. Such lots having at least 300 ft. of street frontage parallel to a freeway and located within 100 ft. of such freeway, may have one 1) additional freestanding sign not to exceed forty 40) ft. in height and three hundred 300) sq. ft. in background sign area. For the purpose of this Section, monument sign" shall mean a sign meeting the standards set forth on Diagram M attached hereto and made a part hereof. Non Conformity/Lot Regulations, Notwithstanding the provisions of Section 17.16.080 of this Code, each lot classified in Zone F-C shall have and maintain the following minimum requirements relating to lot area, lot depth and lot width: 1) Lot Area: For lots upon which it is proposed to locate a combination of the principal uses set forth: a) in Subdivision A of Section 17.021.020, a minimum of four acres; b) in Subdivision B of Section 17.021.020, a minimum of two 2) acres; c) in Subdivisions A and B of Section 17.021.020, a minimum of four 4) acres. 2) Lot Depth: For lots upon which it is proposed to locate a combination of the principal uses set forth: a) in Subdivision A of Section 17•021.020, not less than 300 feet; b) in Subdivision B of Section 17.021.020, not less than 200 feet. c) in Subdivisions A and B of Section 17.021.020, not less than 300 feet. 3) Lot Width; Fot lots upon which it is proposed to locate a combination of the principal uses set forth: a) in Subdivision A of Section 17.021.020, not less than 150 feet; b) in Subdivision B of Section 17.021.020, not less than 400 feet; c) in Subdivisions A and B of Section 17.021.020, not less than 400 feet. 4) Non-Conformity: Any use to which this Chapter applies which does not comply with the provisions of this Title, but not limited to, this Chapter, shall be deemed to be non-conforming and shall be subject to abatement pursuant to this Title. 17.21.050 Design review requirements. All uses, buildings or structures hereinafter proposed to be con- structed, altered or reconstructed on any lot classified in the F-C zone shall be subject to the provisions con- tained in Chapter 17.52." SECTION 2. The City Clerk shall cause publication of this Ordinance in the official newspaper of the City of Baldwin Park as required by law. SECTION 3. That this ordinance shall become operative as of the effective date of City Council Resolution 86-20. That the City Clerk shall certify to the adoption of this ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission.
