AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK AMENDING THE CITY'S
ZONING REGULATIONS RELATING TO DEPARTMENT
STORES AND SWAP MEETS.
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN
AS FOLLOWS;
SECTION 1. That Sections 17.04.181, 17.04.461, and
17.04.586 are hereby added to the Baldwin Park Municipal Code to read
respectively, as follows:
17.04.181 Department Store, Department store' means a
retail store selling a wide variety of goods in several
departments in which: 1) a single business entity
occupies not less than seventy 70) percent of the gross
floor area devoted to the use; and 2) all uses within
the store utilize a centralized accounting system."
17.04.461 Mini-mail. Mini-mall' means the division of
the floor area of a commercial building into five 5) or
more separate businesses which involve retail sales
and/or personal services; required parking shall be
determined by the hearing body as a part of the con-
ditional use permit process."
17.04.586 Swap meet. Swap meet' means any event at
which two 2) or more persons offer personal property, new
and/or used, for sale or exchange and at which a fee is
charged for the privilege of offering or displaying
personal property for sale or exchange, and/or at which
a fee is charged to prospective buyers for admission to
the area where personal property is offered or displayed
for sale or exchange. The number of off street parking
spaces for each swap meet shall be determined by the
hearing body as a part of the conditional use permit
process."
SECTION 2. That Section 17.24.030 of the Baldwin Park
Municpal Code is hereby amended by adding to said Section the following
Subdivision Y:
Y. Swap Meets; Mini-malls."
SECTION 3. That Section 17.20.020 of the Baldwin Park,
Municipal Code is hereby amended by adding thereto as Subdivision A.21,
the following:
21. Department Stores."
SECTION 4. That Section 17.22.020 of the Baldwin Park
Municpal Code is hereby amended by adding thereto as Subdivision A.16,
the following;
16. Department Stores."
SECTION 5. That this Ordinance is hereby declared to be
an urgency measure and shall take effect immediately upon its adoption.

ORD 931 Ü h£Ÿjì ã h A statement of facts constituting the basis of such urgency is as
follows: That this City Council has heretofore imposed a moratorium
on the use of any lot within the City for a swap meet" or a mini-
mall", pending completion of a study conducted by the City staff and
hearings by the Planning Commission and City Council to determine
what zoning measures should appropriately be imposed, with respect
to such uses; that the staff has completed that study; that the
same has been reviewed and considered by the Planning Commission,
which Commission has made certain recommendations to the City Council;
that the City Council has considered the study, the recommendations of
staff and the Planning Commission, and has determined that the zoning
regulations to be made permanently applicable to swap meets, mini-
malls, and departments stores, shall be as set forth in this Ordinance;
that it is necessary that this Ordinance take effect immediately upon
its adoption so as to place into effect those said regulations and to
lift the moratorium heretofore imposed upon such uses so that property
owners within the City who desire to place such uses upon their pro-
perties may do so forthwith, in accordance with the regulations set
forth herein; that the public interest, convenience and necessity
require the immediate adoption of this Ordinance.
SECTION 6. That the City Clerk shall certify to the
adoption of this Ordinance and shall cause the same to be published
in the manner prescribed by law.
