HomeMy WebLinkAboutORD 935ORD 935ÜÂh£ŸjìãTORDINANCE NO. 935 AN ORDINANCE OP THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALDWIN PARK ZONING REGULATIONS RELATING TO THE I-C ZONE. AZC-104) The City Council of the City of Baldwin Park does ordain as follows: SECTION 1. That Title 17 of the Baldwin Park Municipal Code is hereby amended by adding thereto Chapter 17.25, consisting of Sections 17.25.010 through 17.25.050, inclusive, to read as follows: CHAPTER 17.25 Industrial Commercial Zone. 17.25.010 Purpose. In order to provide and encourage development of freeway oriented industrial park and/or office complexes, and to insure compalability with adjacent land uses, the regulations set out in this chapter shall be appiicable to all lots classified in the I-C zone. 17.025.020 Uses Permitted. No person shall use, nor shall any person permit the use of, any lot classified in the I-C zone, for any use other than: A. Principal Uses. Commercial. Any of the Principal Uses permitted in the F-C zone; B. Principal Uses. Industrial. Those Principal Uses first permitted in the C-M zone; C* Principal Uses. Conditional Uses. Any use permitted pursuant to the provisions of Section 17.25.030. D. Accessory Uses. Those uses designated as accessory uses pursuant to this Title. 17.25.030 Uses Permitted by Conditional Use Permit. The following uses shall be permitted on any lot classified in Zone I-C subject to the issuance of a conditional use permit pursuant to Chapter 17.54 hereof: A. Alcoholic beverages, on-site and off-site sales B. Ambulance service C. Automobile service stations D. Automobile washes E. Banks, financial institutions F. Carpet cleaning plants G. Drive-up and drive-thru establishments H. Game arcades I. Hospitals J. Lodges and clubs K. New vehicles or boats, leasing, rental or sales N. Private recreational facilities 0. Private schools P. Theaters walk-in) 0. Vocational or trade schools R. Welding shops S. Any use permitted set forth in Section 17.21.030 hereof. 17.25.040 Development Standards. All uses on lots classified in the I-C zone shall comply with the regulations contained in Chapter 17.16. In addition, the following regulations shall apply to all such uses: A. Yards. 1) For lots upon which one or of the more uses described in Subdivision A of Section 17.25.020 hereof are located or proposed to be located, reguired front yards and side yards adj acent to streets shall have and maintain a depth of not less than 10) ten feet; 2) For lots upon which uses permitted pursuant to Subd ivision B of Section 17.25.020 hereto, are located or to be located required front and side yards adjacent to streets shall have and maintain a depth of not less than fifteen 15) feet; and 3) Not more than 40% of any required front yard or side yard area adjacent to a street shall be used for vehicular driveways; B" Signage: The provisions of Chapter 17.32 hereof shall apply to all uses placed or to be placed on lots classified in the I- C zone except that free standing signs shall not be permitted on any lot classified in the I-C zone. Each such lot may have one 1) monument sign per lot, provided that its total background face area shall not exceed one 1) sq. ft. for each 1ineal ft. of street frontage of the lot, or 100 sq. ft., whichever is lesser. The maximum height of such monument sign shall not exceed nine 9) ft. Such lots having at least 300 ft. of street frontage parallel to a freeway and located within 100 ft. of such freeway, may have one 1) additional freestanding sign not to exceed forty 40) ft. in height and three hundred 300) sq. ft. in background sign area. Non Conformity/Lot Regulations. Notwith- standing the provisions of Section 17.16.080 of this Code, each lot classified in Zone I-C shall have and maintain the following minimum requirements relating to lot area, lot depth and lot width: 1) Lot Area: For lots upon which it is proposed to locate a combination of the Principal Uses set forth: a) in Subdivision A of Section 17.025.020, a minimum of four 4) acres; b) in Subdivision B of Section 17.025.020, a minimum of two 2) acres? c) in Subdivisions A and B of Section 17.025.020, a minimum of four 4) acres. 2) Lot Depth: For lots upon which it is proposed to locate a combination of the Principal Uses set forth: a) in Subdivision A of Section 17.025.020, not less than 200 feet; b) in Subdivision B of Section 17.025.020, not less than 300 feet. c) in Subdivisions A and B of Section 17,025.020, not less than 300 feet. 3) Lot Width: For lots upon which it is proposed to locate a combination of the Principal Uses set forth: a) in Subdivision A of Section 17.025.020, not less than 400 feet; b) in Subdivision B of Section 17.025.020, not less than 150 feet; c) in Subdivisions A and B of Section 17.025.020, not less than 400 feet. 4) Load ing and Storage. The provisions of Section 17.24.040 B. shall apply to all lots classified in Zone I-C; and 5) Non-Conformity: Any use to which this Chapter applies which does not comply with the provisions of this Title, but not 1imited to, this 3- BIB] 37971-U01 ORD-U02 935-U02 LI2-U03 FO4404-U03 FO33426-U03 DO33665-U03 C5-U03 ORDINANCES-U03 12/16/2003-U04 ROBIN-U04 ORD 935ÜÂh£ŸjìãTChapter, shall be deemed to be non- conforming and shall be subject to abatement pursuant to this Title. 17.25.050 Design review requirements. All uses, building or structures hereinafter proposed to be constructed, altered or reconstructed on any lot classified in the I-C zone shall be subject to the provisions contained in Chapter 17.52." SECTION 2. That this Ordinance shall not become operative until Resolution No. 86-20 becomes effective. SECTION 3.
