HomeMy WebLinkAboutORD 937ORD 937ÜÂh£ŸjìãMORDINANCE NO. 937 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A ZONING CODE ADMENDMENT TO ADD CHAPTER 17.31 HOUSING INCENTIVES APPLICANT: CITY OF BALDWIN PARK, CASE NO: AZC-107). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS; SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a. That on the 23rd day of April, 1986, the Planning Commission held a duly noticed public hearing to consider the adoption of amendments to the Baldwin Park Zoning Code relating to Housing Incentives Den- sity Bonuses); and b. The proposed change provides for the protection of the health, safety, and welfare of the residents of Baldwin Park, and c. The proposed change is consistent with the spirit and intent of the General Plan. d. That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, it was determined that the public in- terest, necessity, convenience, and general welfare required the approval of the Zoning Code amendment, herein described. SECTION 2. That Chapter 17.31 is hereby added to Title 17 of the Baldwin Park Municipal Code, to read as follows: Chapter 17.31 HOUSING INCENTIVES 17.31.010 Purpose. The purpose of this chapter is to establish de- velopment policies which assist in the provision of affordable housing for low and moderate income households. 17.31.020 Conditional Use Permit required. A conditional use permit shall be required for any project as to which an Agreement hereafter Agreement") is entered into with the City pursuant to Section 65915 or 65915.5 of the Government Code hereafter Project") prior to the effective date of any such Agreement. 17.31.030 Density Bonus. The maximum density bonus allowed shall be 25 percent of the allowable density. 17.31.040 Development Plan Submittal. Concurrently with an application, as prescribed by the Director, the following shall be submitted: 1. Location of dwelling units within the Project, intended for afford- able housing; and 2. The total number of dwelling units in the Project, and identifica- tion of dwelling units designated as affordable units, and if the units are rental or for sale; and 3. Proposed rent schedules, or sale prices. Affordable housing units permitted by such an Agreement shall: A. Be reasonably dispersed throughout the Project; and B. The average number of bedrooms per designated dwelling unit shall be consistent with the average number of bedrooms per unit in the Project; and C. Be designed to harmonize architecturally with other structures and units in the project. 17,31,060 Resale and rental controls A. An Agreement shall be re- corded in the Office of the County Recorder of Los Angeles County, California, and shall constitute a covenant running with the land for the benefit of the City of Baldwin Park. The Agreement shall reserve, pursuant to Sections 65915 or 65915.5 of the Government Code, housing units for qualified households for a minimum period of 30 years. In- dividual affordable housing units which are for sale shall be owner occupied. Upon change in ownership or tenancy of an affordable housing unit, notice thereof, shall be given to the Housing Authority. The Housing Authority shall review each tenant or owner proposed to occupy an affordable housing unit to determine the eligibility of such tenant or owner. B. The Housing Authority shall have the right of first refusal to lease affordable rental housing units constructed pursuant to such an Agreement. Said right shall be assignable by the Housing Authority to prospective tenants determined by the Authority to be eligible, therefor. Upon subsequent termination of any such tenancy, the right of first refusal shall revert to the Housing Authority for subsequent assignment to an eligible tenant, if the Housing Authority wishes to excise said right." SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the pro- posed Negative Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The City Clerk of the City of Baldwin Park shall file the Negative Declaration of Environmental Impact.
