HomeMy WebLinkAboutORD 943ORD 943ÜÂh£ŸjìãORDINANCE NO. 943 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING A MORATORIUM ON CONSTRUCTION AND USE OF BUILDINGS FOR MOTEL OR HOTEL PURPOSES. URGENCY MEAURES) The City Council of the City of Baldwin Park does ordain as follows: SECTION 1. The City Council of the City of Baldwin Park does hereby find, determine and declare, as follows: a) That the City staff has indicated to this Council that land use and police problems have arisen with respect to a number of motels and hotels located within the City's boundaries; b) That such problems range from serious criminal law problems, i.e. prostitution, drug dealing, etc., and the use of such hotels and motels as apartments and not for transient occupancy only in violation of City Building and Zoning codes; c) That it is necessary to re-examine all of the zoning regulations, and other Municipal Code provisions relating to hotels and motels to determine what steps can be taken so as to properly regulate and allow hotels and motels within the City but at the same time insuring that the use of such facilities is proper i.e. for transient occupancy only, and to eliminate, to the extent possible, police problems inherent of current usage of such hotels and motels; d) That it is necessary, pending the conduct of such study and the enactment of regulations based thereon, that a moratorium on the con- struction of any new or additional hotel and motel units must be imposed pending the completion of such study and report e) That if such moratorium were not imposed, construction of such additional hotel and motel units would be undertaken which could very well frustrate the zoning proposal to be examined and studied; f) That the public interest, convenience and necessity require the extension of the moratorium relating to motels and hotels as imposed by Ordinance No. 928. SECTION 2. That notwithstanding any provision of the Baldwin Park Municipal Code to the contrary, during such time as this Ordinance is in full force and effect, no person shall construct or locate any hotel or motel upon any real property located within the boundaries of the City. For the purpose of this Section hotel" and motel" shall be defined as set forth in the Baldwin Park Municipal Code. That this Ordinance is hereby declared to be an urgency measure and shall take effect immediately upon its adoption. A statement of facts constituting the basis of such urgency is as above set forth. This Ordinance is adopted pursuant to Planning and Zoning Law of the State of California and other applicable law. This Ordinance shall remain in effect for a period of 90 days from and after its adoption and may, thereafter, be extended in the time and manner provided by law. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner prescribed by law.
