HomeMy WebLinkAboutORD 953ORD 953x ôÎÞh0 9 ORDINANCE NO. y53 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A ZONING CODE AMENDMENT ALLOWING ALUMINUM RECYCLING MACHINES IN THE FC, C-2, CM, AND 1C ZONES IN CONJUNCTION WITH A GROCERY MARKET APPLICANT: CITY OF BALDWIN PARK? CASE NO.: AZC-110). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin park does hereby find, determine, and declare as follows: a) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend the approval of the zoning cod® amendment allowing aluminum recycling machines in the FC, C«2, CM and 1C zonal in con- junction with a grocery market; and b) That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, it was determined that the public interest, necessity, convenience, general welfare required the approval of the Zoning Code amendment, herein described. SECTION 2. That Section 17.21.030 of the Baldwin Park Zoning Code is hereby amended by the addition of the following subparagraphs: 17.21.030 Uses permitted by conditional use permit. R. Aluminum recycling machines in conjunction with a grocery market with a minimum floor area of 20,000 square feet." SECTION 3. That Section 17.22.030 of the Baldwin Park Zoning Code is hereby amended by the addition of the following sub- paragraph: 17.22.030 Uses permitted by conditional use permit. Q. Aluminum recycling machines in conjunction with a grocery market with a minimum floor area of 20,000 square feet." SECTION 4. That Section 17.24.030 of the Baldwin Park Zoning Code is hereby amended by the addition of the following aubparagraphs: 17.24.030 Uses permitted by conditional use permit, U. Aluminum recycling machines in conjunction with a grocery market with a minimum floor area of 20,000 square feet." That Section 17.25.030 of the Baldwin Park Zoning Code is hereby amended by the addition of the following subparagraph: 17,25.030 Uses permitted by conditional use permit. T. Aluminum recycling machines in conjunction with a grocery market with a minimum floor area of 20,000 square feet." SECTION 6. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Nega- tive Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 7. That the City Clerk certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same tp th9 c^tary of t;he Planning commission.
