HomeMy WebLinkAboutORD 955ORD 955x ôÎÞbORDINANCE NO. 955 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A CHANGE OF ZONE FROM R-l, SINGLE FAMILY RESIDENTIAL TO R-l PD), SINGLE FAMILY RESIDENTIAL PLANNED DEVELOPMENT OVERLAY ZONE ON APPROXIMATELY 6 ACRES; APPLICANT: ALEXANDER/CATANIA, CASE NO.: Z-464; LOCATION: 12845, 55 & 67 SALISBURY STREET). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1, That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That an application for a change of zone from R-l, Single Family Residential to R-l PD), Single Family Residential Planned Development Overlay Zone was submitted by the owners of real property located at 12845, 55 & 67 Salisbury Street, described, more particularly as follows: A 6 acre portion of Parcels 36, 37 & 38 on Page 10 of Map Book 8551 of the Los Angeles County Assessor's Records as shown on Exhibit C"; and b) That pursuant to the applicable provisions of the Planning and Zoning Law Section 65800 et. seq. of the Government Code of the State of California), studies were commenced for the purpose of amending the Zoning Map of the City of Baldwin Park; and c) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend the approval of the reclassification to R-l PD) Single Family Residential Planned Develop- ment Overlay Zone; and d) That the City Council conducted a duly noticed hearing on said matter/ and based upon the evidence presented, and each member being familiar with the site, it was determined that the public interest, necessity, con- venience, and general welfare require the change in zone reclassification, herein described. SECTION 2. That notwithstanding the provisions of Sec- tion 17.54 of the Baldwin Park Municipal Code, the zoning classifica- tion of the property is hereby reclassified from zone R-l, Single Family Residential to R-l PD), Single Family Residential Planned Development Overlay Zone. SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. That the City Clerk shall certify to the adop- tion of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission.
