HomeMy WebLinkAboutORD 956ORD 956x ôÎÞ]ORDINANCE NO. 956 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A CHANGE OF ZONE FROM R-3 HIGH DENSITY RESIDENTIAL) TO R-l SINGLE FAMILY RESIDENTIAL) AND R-l PD) SINGLE FAMILY RESIDENTIAL PLANNED DEVELOPMENT OVERLAY ZONE) APPLICANT: CITY OF BALDWIN PARK; CASE NO.: Z-462; LOCATION: AMAR/JUDITH AREA). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That an application for a change of zone from R-3 High Density Residential) to R-l Single Family Residential) was submitted by the City of Baldwin Park for property located as shown on Exhibit A"; and b) That pursuant to the applicable provisions of the Planning and Zoning Law Section 65800 et. seq. of the Government Code of the State of California), studies were commenced for the purpose of amending the Zoning Map of the City of Baldwin Park; and c) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity convenience, and general welfare re- quired that it recommend the approval of the re- classification to R-l Single Family Residential) and R-l PD) Single Family Residential Planned Develop- ment Overlay Zone) as shown in Exhibit D" and described as follows: 1. Parcels 9, 10, 11, 12 & 13 on Page 9, Parcels 32, 33, 36, 37, 38, 46, 42 & 48 on Page 12, and Parcels 4 thru 41 inclusive on Page 10 of Map Book 8559 of the Los Angeles County Assessor's Records. Change in zone from R-3 to R-l; and 2. Parcels 1 thru 15 inclusive, 17, 18, 19 & 37 on Page 15 of Map Book 8564, Parcels 1, 2, 3, 46 & 47 on Page 10 and Parcels 39, 40 & 47 on Page 12 of Map Book 8559 of the Los Angeles County Assessor's Records. Change in zone from R-3 to R-l PD). d) That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, and each member being familiar with the site, it was deter- mined that the public interest, necessity, convenience, and general welfare require the change in zone classifi- cation, herein described. SECTION 2. That notwithstanding the provisions of Section 12.54 of the Baldwin Park Municipal Code, the zoning classification of the property is hereby reclassified from zone R-3 to R-l and R-l PD). SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The Secretary of the Planning Commission shall file the Negative Declaration of Environ- mental Impact.
