HomeMy WebLinkAboutORD 963ORD 963x ôÎÞJORDINANCE NO. 963 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A ZONING CODE AMENDMENT TO CHAPTERS 17.16 17.21, 17.23, 17.24 AND 17.25 OF THE ZONING CODE ADDING INTERIM USES NOT OTHERWISE PRO- VIDED FOR IN THE FC, 01, 1C, AND CM ZONE DISTRICTS WITH A CONDITIONAL USE PERMIT APPLICANT: CITY OF BALDWIN PARK, CASE NO.: AZC-114). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a. That on the 10th day of June, 1987, the Planning Commission held a duly noticed public hearing on the application for an amendment to the Baldwin Park Zoning Code. b. The proposed change provides for the protection of the health, safety, and welfare of the residents of Baldwin Park; and c. The proposed change is not detrimental to the pro- perties within the City; and d. The proposed change is consistent with the spirit and intent of the General Plan. e. That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, it was determined that the public in- terest, necessity, convenience, and general welfare required the approval of the Zoning Code amendment, herein described. SECTION 2. That Chapter 17.16 of the Baldwin Park Munici- pal Code, are hereby amended to read as follows: 17.16.170 Interim Uses. Notwithstanding any other pro- vision of this Chapter, temporary uses may be placed on lots classified in zones FC, 01, 1C and CM only under the following circumstances: a) That such use is temporary or interim in nature and will be completely removed from the lot where it is proposed to be located within the time set forth for such removal as a condition of approval on the issu- ance of the conditional use permit relating thereto, or, if no time is specified, a period of one 1) year from and after the date of approval of the con- ditional use permit; and b) That no conditional use permit shall be issued for such a temporary use unless and until the Redevelop- ment Agency has reviewed the same and has determined that the redevelopment process will be implemented or furthered by such usage; and that such usage will be consistent with the provisions of any applicable redevelopment plan; and BIB] 37970-U01 ORD-U02 963-U02 LI2-U03 FO4404-U03 FO33425-U03 DO33442-U03 C5-U03 ORDINANCES-U03 12/11/2003-U04 ROBIN-U04 ORD 963x ôÎÞJc) That the proposed temporary industrial use. SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the pro- posed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The Secretary of the Planning Commission shall file the Negative Declaration of Environmental Impact. PASSED AND APPROVED MAYOR ATTEST: li^NDA L.
