HomeMy WebLinkAboutORD 964ORD 964x ôÎÞGORDINANCE NO. 964 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A ZONING CODE ADMENDMENT TO CHAPTER 17.16 OF THE ZONING CODE ADDING DEVELOPMENT STANDARDS FOR SECURITY BARS APPLICANT: CITY OF BALDWIN PARK; CASE NO.: AZC-113). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a. That on the 10th day of June/ 1987, the Planning Commission held a duly noticed public hearing on the application for an amendment to the Baldwin Park Zoning Code. b. The proposed change provides for the protection of the health, safety, and welfare of the residents of Baldwin Park; and c. The proposed change is not detrimental to the pro- perties within the City; and d. The proposed change is consistent with the spirit and intent of the General Plan. e. That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, it was determined that the public in- terest, necessity, convenience, and general welfare required the approval of the Zoning Code amendment herein described. SECTION 2. That Section 17.16.170 of the Baldwin Park Municipal Code, is hereby amended to read as follows: 17.16,170 Security Bars, A. Definition. Security Bars" means metal bars, in- cluding but not limited to wrought iron window guards and sliding scissor gates, attached to or covering a window or glass door which are intended to provide additional protection against vandalism and burglaries. Bt Location. Security bars may only be mounted on the inside of an exterior building wall, window or glass door. C. Existing Nonconforming Security Bars Amortization. As of the effective date of the regulations contained in this section, all nonconforming security bars shall be abated and removed or made to comply with the provisions of this section within two years." SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the pro- posed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The Secretary of the Planning Commission shall file the Negative Declaration of Environmental Impact. PASSED AND APPROVED ON August 5 1987.
