HomeMy WebLinkAboutORD 965ORD 965x ôÎÞAORDINANCE MO. 965 AM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A ZONING CODE ADMENDMENT TO CHAPTERS 17.04 AND 17.10 OF THE ZONING CODE TO REVISE THE R-l YARD AREA REQUIREMENTS FOR REVERSE CORNER LOTS APPLICANT: CITY OF BALDWIN PARK; CASE NO.: AZC-116). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS; SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine/ and declare as follows: a. That on the 8th day of July, 1987, the Planning Commission held a duly noticed public hearing on the application for an amendment to the Baldwin Park Zoning Code. b. The proposed change provides for the protection of the health/ safety, and welfare of the residents of Baldwin Park; and c. The proposed change is not detrimental to the pro- perties within the City; and d. The proposed change is consistent with the spirit and intent of the General Plan. e. That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, it was determined that the public in- terest, necessity, convenience, and general welfare required the approval of the Zoning Code amendment herein described. SECTION 2. That Sections 17.04.415 and 17.10.075 of the Baldwin Park Municipal Code, are hereby amended to read as follows: 17.04.415 Lot line, front. Front lot line" means a line separating an interior lot from a street, or a line separating the narrower street frontage of a corner lot from the street, or in the case of a reverse corner lot, either street side property line may be considered the front lot line. 17.10.075 Reverse Corner Lots Yard areas for reverse corner lots. Each reverse corner lot shall observe the minimum required yard areas as shown in Diagram N", attached to the ordinance codified in this title and on file at the City Clerk's office and as follows: A. Front Yards. The depth of the required front yard area shall be measured from either street side property 1ine, the remaining yard area adj acent to the street shall be considered the side yard adjacent to the street. Front yards shall have a minimum depth as follows: 1. Fifteen feet for the dwelling portion of a single-family dwelling. B. Side yards. A side yard having a width of not less than five 5) feet/ except that a reverse corner lot shall observe a side yard depth of not less than fifteen 15) feet on the street side for the dwelling portion and twenty 20) feet on the street side for garage structures, except that when a garage is situated such that an automobile can enter and park at an angle which is generally parallel to the side lot line, the minimum side yard depth shall be fifteen 15) feet. C. Rear Yards. A rear yard shall have a depth of twenty 20) feet, except that twenty-five per- cent of a rear yard area of an existing single- family dwelling may be covered by structures or buildings if a rear yard of at least five feet is established and maintained." SECTION 3, That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the pro- posed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The Secretary of the Planning Commission shall file the Negative Declaration of Environmental Impact. PASSED AND APPROVED ON August 5" / 1987. MAYOR ATTEST: gL^><V^_________ INDA L.
