HomeMy WebLinkAboutORD 969ORD 969pT3(ÌìÞ1ORDINANCE NO. 969 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A CHANGE OF ZONE FROM R-l SINGLE FAMILY RESIDENTIAL) AND R-3 MULTIPLE FAMILY RESIDENTIAL) TO OS OPEN SPACE) ON APPROXIMATELY 3.0 ACRES APPLICANT: MEJIA WHOLESALE NURSERY, INC.; CASE NO.: Z-467; LOCATION GENERALLY DESCRIBED AS PROPERTIES BENEATH THE CITY OF LOS ANGELES WATER AND POWER RIGHT-OF-WAY BETWEEN DALEWOOD AVENUE AND WALNUT CREEK WASH). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Baldwin Park does hereby find, determine, and declare as follows: a) That an application for a change of zone from R-3 and R-l to OS was submitted by the owners of real property located as previously described and more particularly as shown on Exhibit C"; and b) That pursuant to the applicable provisions of the Planning and Zoning Law Section 65800 et. seq. of the Government Code of the State of California) studies were commenced for the purpose of amending the Zoning Map of the City of Baldwin Park; and c) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend the approval of the reclassification to OS; and d) That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, and each member being familiar with the site, it was determined that the public interest, necessity, convenience, and general welfare require the change in zone classification, herein described. SECTION 2. That notwithstanding the provisions of Section 12.54 of the Baldwin Park Municipal Code, the zoning classification of the property is hereby reclassified from zone R-3" and R-l" to OS". SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Nega- tive Declaration, and comments relating thereto. That the City Coun- cil, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The Secretary of the Planning Commission shall file the Negative Declara- tion of Environmental Impact.
