Home My WebLink AboutORD 973ORD 973pT3(ÌìÞ%ORDINANCE NO. 973 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING AN AMEND- MENT TO THE BALDWIN PARK ZONING CODE PRO- VIDING FOR RECYCLING CENTERS IN THE C-2, FC, CM, AND 1C ZONES IN CONJUNCTION WITH A GROCERY MARKET HAVING GROSS ANNUAL SALES OF TWO MILLION DOLLARS OR MORE APPLICANT; CITY OF BALDWIN PARK; CASE NO.: AZC-117). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a. That on the 14th day of October, 1987, the Planning Commission held a duly noticed public hearing on the application for an amendment to the Baldwin Park Zoning Code. b. The proposed change provides for the protection of the health, safety, and welfare of the residents of Baldwin Park; and c. The proposed change is not detrimental to the properties within the City; and d. The proposed change is consistent with the spirit and in- tent of the General Plan; and e. That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, it was determined that the public interest, necessity, con- venience, and general welfare required the approval of the Zoning Code Amendment, herein described. SECTION 2. That Chapter 17.04 of the Baldwin Park Zoning Code is hereby amended to read as follows: 17.04.537 Recycling Facility. Recycling facility" means a center for the collection and/or processing of recycl- able materials. 17.04.546 Reverse Vending Machine. Reverse Vending Machine" means an automated mechanical device which accepts all empty beverage containers required to be recycled by the State Division of Recycling pursuant to AB2020 including but not limited to aluminum cans, glass, non aluminum metal cans and plastic bottles, and issues a cash refund or redeemable credit slip with a value not less than the containers redemption value as determined by the State. A reverse vending machine may sort and process containers mechanically provided that the entire process is enclosed within the machine. 17.04.127 Bulk Reverse Vending Machine. Bulk Reverse Vending Machine" means a reverse vending machine that is larger than 50 square feet; is designed to accept more than one container at a time; will pay by weight instead of number of containers; and is customarily installed in a parking lot." That Chapter 17.16 of the Baldwin Park Zoning Code is hereby amended to read as follows: GENERAL REGULATIONS—COMMERCIAL AND INDUSTRIAL ZONES 17.16.065 Reverse Vending Machines. An administrative permit for a reverse vending machine shall be issued on a lot classified in the FC, C-2, 1C, and CM zones provided that all of the following items have been met or otherwise complied with: 1. That each reverse vending machine must be capable of dispensing cash for aluminum, glass, plastic, and non aluminum metals; and 2. That each reverse vending machine shall only be allowed on a lot upon which is located a supermarket having gross annual receipts of two 2) million dollars or greater; and 3. That each reverse vending machine shall be located adjacent to the building wall and no further than twenty 20) feet from a main entrance to the super- market or inside the store; and 4. That the size and bulk of each reverse machine shall not be larger than fifty 50) square feet and shall not be greater than eight 8) feet in height; and 5. The location of each reverse vending machine shall not obstruct pedesterian or vehicular circulation; and 6. Each reverse vending machine shall be constructed with durable waterproof and rustproof materials; and 7. Each reverse vending machine shall be illuminated to ensure comfortable and safe operation; and 8. Each reverse vending machine shall be available and in operation at a minimum during the operating hours of the supermarket; and 9. Signage on a reverse vending machine shall not exceed a total background sign face area of four 4) square feet, exclusive of operating instructions; and 10. Each reverse vending machine shall be clearly marked to identify the type of material to be deposited, operating instructions, and the identity and phone number of the owner or a person to call if the machine is inoperative; and 11. Each reverse vending machine shall be maintained in a clean, litter-free condition on a daily basis; and 12. That the color of the reverse vending machine shall be in harmony with the surrounding buildings and develop- ment SECTION 4. That Section 17.21.020 of the Baldwin Park Zoning Code is hereby amended to read as follows: A. Principal Uses, Commercial. 28. Reverse Vending Machines. That Section 17.21.030 of the Baldwin Park Zoning Code is hereby amended to read as follows: 17.21.030 Uses permitted by conditional use permit. R. Mobile recycling facilities, staffed recycling facilities, and bulk reverse vending machines in con- junction with a grocery market having gross annual sales of two million dollars or greater;" SECTION 6. That Section 17.22.020 of the Baldwin Park Zoning Code is hereby amended to read as follows: A. Principal Uses, Commercial. 18. Reverse Vending Machines. SECTION 7. That Section 17.22.030 of the Baldwin Park Zoning Code is hereby amended to read as follows: 17.22.030 Uses Permitted by Conditional Use Permit. Q. Mobile recycling facilities, staffed recycling facilities, and bulk reverse vending machines in conj unction with a grocery market having gross annual sales of two million dollars or greater;" SECTION 8. That Section 17.24.020 of the Baldwin Park Zoning Code is hereby amended to read as follows: A. Principal Uses, Commercial. 24. Reverse Vending Machines. SECTION 9. That Section 17.24.030 of the Baldwin Park Zoning Code is hereby amended to read as follows: 17.24.030 Uses Permitted by Conditional Use Permit. U. Mobile recycling facilities, staffed recycling facilities, and bulk reverse vending machines in conjunction with a grocery market having gross annual sales of two million dollars or greater;" SECTION 10. That Section 17.25.030 of the Baldwin Park Zoning Code is hereby amended to read as follows: 17.25.030 Uses Permitted by Conditional Use Permit. T. Mobile recycling facilities, staffed recycling facilities, and bulk reverse vending machines in conjunction with a grocery market having gross annual sales of two million dollars or greater;" SECTION 11. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the pro- posed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment, SECTION 12. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The City Clerk shall file the Negative Declaration of Environmental Impact.
