HomeMy WebLinkAboutORD 975ORD 975pT3(ÌìÞ ORDINANCE NO- 975 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A CHANGE OF ZONE FROM R-3 TO C-2 ON APPROXIMATELY 3.12 ACRES APPLICANT: CITY OF BALDWIN PARK/- LOCATION: 4125 THRU 4203 BOGART AVENUE, 14446 THRU 14455 1/4 PALM- ROSE STREET AND 14443 THRU 14461 INA STREET). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS; SECTION 1. That the City Council of the City of Baldwin Park does herby find, determine, and declare as follows: a) That an application for a change of zone from R-3, High Density Residential to C-2, General Commercial was sub- mitted for property located at 4125 thru 4203 inclusive on the west side of N. Bogart Avenue, 14446 thru 14455 1/4 inclusive on the south side of E. Palmrose Street, and 14443 thru 14461 inclusive on the north side of E. Ina Street more particularly described as Parcels 4 thru 7 inclusive and 18 thru 27 inclusive on Page 4 and Parcel 11 on Page 3 of Map book 8437 of the Los Angeles County Assessor's Records, as shown on Exhibit B"; and b) That pursuant to the applicable provisions of the Planning and Zoning Law Section 65800 et. seq. of the Government Code of the State of California), studies were commenced for the purpose of amending the Zoning Map of the City of Baldwin Park; and c) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend the approval of the reclassification to C-2; and d) That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, and each member being familiar with the site, it was determined that the public interest, necessity, conveni- ence, and general welfare require the change in zone classification, herein described- SECTION 2. That notwithstanding the provisions of Section 12.54 of the Baldwin Park Municipal Code, the zoning classification of the property is hereby reclassified from zone R-3 to C-2* SECTION 3. That the City Council on March 18, 1987 reviewed and considered the environmental initial study prepared for the Westar Shopping center Project which included the proposed zone changes Z- 471) and General Plan amendment AGP-79). That the City Council, based upon its public review, approved the Negative Declaration of Environmental Impact, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission.
