HomeMy WebLinkAboutORD 0983ORD 0983pT3(ÌìÝÑORDINANCE NO. 983 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM R-3, HIGH DENSITY RESIDENTIAL TO R-3 PD), HIGH DENSITY RESIDENTIAL PLANNED DEVELOP- MENT OVERLAY ZONE ON APPROXIMATELY 3.17 ACRES APPLICANT: BALDWIN PROPERTIES/ LTD.; CASE NO.: Z-476; LOCATION: 14845 PACIFIC AVENUE, BALDWIN PARK, CALIFORNIA). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That the owners of certain real property approxi- mately 3.17 acres in area located at 14845 Pacific Avenue, more particularly described as Parcel 37, 43, 47 and 59 on Page 15 of Map Book 8438 of the Los Angeles County Assessor's Records hereinafter Property") heretofore made application for a zone change for said property from R-3, High Density Residential to R-3 PD) High Density Residential Planned Development Overlay zone therewith a development plan for an 18 unit apartment herein- after Plan")7 and b) That pursuant to the applicable provisions of the Planning and Zoning Law Section 65800 et. seq. of the Government Code of the State of California), studies were commenced for the purpose of amending the Zoning Map of the City of Baldwin Park; and c) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend the denial of the zone change and Plan; and d) That the City Council conducted a duly noticed hearing on said matter/ and based upon the evidence presented, and each member being familiar with the site, it was determined that the public interest, necessity, convenience, and general welfare require the change in zone classification, herein described. SECTION 2. That notwithstanding the provisions of Section 12.54 of the Baldwin Park Municipal Code, the zoning classification of the property is hereby reclassified from zone R-3 to R-3 PD). SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Nega- tive Declaration, and comments relating thereto. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The City Clerk shall file the Negative Declaration of Environmental Impact.
