HomeMy WebLinkAboutORD 0988ORD 0988pT3(ÌìÝøORDINANCE NO. 988 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A ZONING CODE AMENDMENT TO CHAPTER 17.24, CM COMMERCIAL MANU- FACTURING ZONE APPLICANT: BARNEY FLAM; CASE NO.: AZC-119). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a. That on the 27th day of April, 1988, the Planning Commission held a duly noticed public hearing on the application for an amendment to the Baldwin Park Zoning Code Chapter 17.24 to include machine shops, metal manufacturing and welding shops as permitted principal uses in the CM, Commercial Manufacturing zone. b. The proposed change provides for the protection of the health, safety, and welfare of the residents of Baldwin Park; and c. The proposed change is not detrimental to the pro- perties within the City; and d. The proposed change is consistent with the spirit and intent of the General Plan. e. That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, it was determined that the public in- terest, necessity, convenience, and general welfare required the approval of the Zoning Code amendment, herein described. SECTION 2. That Sections 17.24.020 and 17.24.030 of the Baldwin Park Municipal Code are hereby amended to read as follows: 17.24.020 Uses permitted. No person shall use, nor shall any person permit the use of, any property class- ified in the C-M zone for any use other than the follow- ing: A. Principal Uses, Commercial, Manufacturing 1. Uses permitted in the C-2 zone; 2. Assembly and manufacture of electrical appli- ances such as: a. Electronic instruments and devices, b. Ceramic products, manufacture of, including figurines, using only previously pulverized clay and kilns fired only by electricity or low-pressure gas; 7. Confectionery manufacturing; 8. Cookie, donut, ice cream, pie manufacturing; 9. Cosmetic, perfume, toiletries manufacturing 10. Dry cleaning, dyeing establishments; 11. Furniture and appliance stores 12. Glass studios, staining, edging, beveling and silvering in connection with sales of mirrors and glass for decorating purposes; 13. Jewelry manufacturing; 14. Laboratory, film, motion picture, research or testing; 15. Janitorial supplies/ wholesales 16. Machine shops; 17. Manufacturing, assembly, compounding or treat- ing of articles or merchandise from the follow- ing previously prepared materials: a. Bone, b. Canvas, c. Cellophane, d. Cloth, e. Cork, f. Feathers, g. Felt, h. Fur, i. Glass, j. Leather except machine belting), K. Metals, 1. Paper, m. Plastics and synthetics from previously molded materials), n. Rope, o. Rubber, fabrication of products made from finished rubber, p. Shell, q. Textiles, r. Wire, s. Yarn 18. Offices, business, professional and medical; 19. Publishing and printing shops; 22. Restaurants, cafes; 23. Stone, precious or semiprecious, manufacturing products thereof; 24. Welding shops, not including wrought iron fence manufacturers; 25. Any other use as determined to be a permitted use by the director pursuant to Section 17.06.060. B. Principal uses—Conditional Uses. Any use permitted pursuant to Section 17.24.030. c. Accessory Uses. Those uses designated as accessory uses pursuant to the provisions of this title. 17.24.030 Uses permitted by conditional use permit. The following uses may be permitted subject to the issuance of a conditional use permit pursuant to Chapter 17.54: A. Alcoholic beverage sales, on-site and off- site sales; B. Automobile service and repair facilities; C. Automobile service stations; D. Automobile washes; E. Banks, financial institutions F. Carpet cleaning plants; G. Drive-up, drive-thru estabiishments H. Game arcades; I. Hospitals; J. Kennels, animal hospitals; K. Lodges and club; L. New vehicles or boats, leasing, rental or sales; M. Private recreational facilities; N. Theaters walk-in); 0. Truck, trailer terminals, rental concerns; P. Vocational, trade schools; Q. Swap meets; mini-malls." SECTION 3. That the City Council at the time of the pub- lic hearing on the above matter reviewed and considered the proposed Negatove Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The City Clerk shall file the Negative Declaration of Environmental Impact. PASSED AND APPROVED ON JUNE 1 1988.
